There was always going to be causalities in the merger of behemoths Activision and Vivendi, and one of the first appears to be the Sierra publishing label. Formed in 1979 by Ken (programmer) and Roberta (storyteller) Williams, Sierra On-Line was responsible for many much-loved and pioneering games, including King's Quest, B.C's Quest for Tires, Space Quest, Leisure Suit Larry, Police Quest, The Incredible Machine, Caesar, Aces of the Pacific and Gabriel Knight. Games including Phantasmagoria, You Don't Know Jack, IndyCar Racing II, Grand Prix Legends, Half-Life, Homeworld, Metal Arms, Evil Genius, World in Conflict, F.E.A.R and recent Legend of Spyro titles were also published under the Sierra label. Larry creator Al Lowe recently told Edge that Vivendi had "allowed the (Sierra) brand to wither into meaninglessness", while Ken Williams also agrees that it should now be allowed to rest in peace, which Activision Blizzard seems to be doing as it cancels or off-loads various Sierra properties. We've got good news and bad news coming in in light of the recent merger between Activision and Vivendi . The good news is that Activision has announced that it will be keeping six of Vivendi 's game franchises: Crash Bandicoot , Ice Age , Spyro the Dragon , The Mummy: Tomb of the Dragon Emperor , Prototype (still in development), and a yet-to-be-identified title also under works. The bad news: Activision further confirmed to GameSpot that the five titles mentioned are the only ones the company will be publishing. Vivendi's operations are being streamlined to help the company focus on the five franchises in Activision's plans. To this end, Radical Entertainment and High Moon Studios are expected to experience realigned staffing. Activision is also exploring several options regarding Massive Entertainment , Swordfish Studios , Vivendi Games Mobile, and Sierra Online which may including closing down or selling the four studios. Remember last year's big news about Activision and Vivendi forming a merger ? While the proposal sounds a financially enticing at US 27.50 per share offer, there are some shareholders who certainly aren't buying into the whole deal and even filed an injunction request in an attempt to halt the merger. The injunction Suit was filed in the Delaware Court of Chancery last February by the Wayne County Employee's Retirement System. For those who aren't too familiar with law parlance (we don't blame you), an injunction is a court order that...yes, blocks a party from doing certain acts. In this case, from Activision merging with Vivendi . However, Activision has recently issued a statement that the Delaware Court junked the request to stop the merger with Vivendi from happening, and has scheduled a stockholders meeting on July 8, where they will "consider and vote on proposals to approve the transaction." If everything goes as planned in the meeting, Activision and Vivendi will be known collectively as Activision Blizzard effective July 9. Filed under: Business One of the major outstanding questions surrounding the Activision Blizzard merger was: "What the hell is going to happen to Vivendi's other video game division, Sierra?" The new super-publisher announced it will be keeping five of Sierra's franchises total: Crash Bandicoot , Ice Age , Spyro , the still-in-development Prototype , and another as-yet-unannounced title. We're currently looking into the fate of Sierra's other publishing arrangements: Tim Schafer's Brütal Legend (oh, Brütal Legend , we're so sorry!), Ghostbusters: The Video Game , WET , and Chronicles of Riddick: Assault on Dark Athena . Activision Blizzard is also reviewing Sierra's other properties that they will not be publishing: think Bourne , 50 Cent: Blood on the Sand , World in Conflict , et al. Activision Publishing CEO Mike Griffith says, "We are reviewing our options regarding those titles that we will not be publishing." Those games won't be published by Blizzavision because they're not "a strong fit with [Activision Blizzard's] long-term product strategy." As we all know, Activision Blizzard is killing Vivendi Games' Sierra label and all the crappy, and some of the not-so-crappy, games it was publishing (some might even argue it's keeping a few of the Sierra franchses that are crappy, but that's a separate issue). But there was one crappy game that was so close to being publisher, and was literally being manufactured with "Sierra" on the box as the merger happened a few weeks ago, that Activision Blizzard couldn't stop it. And so the final game to go out under the Sierra label is "The Mummy: Tomb of the Dragon Emperor," a PS2 and Wii game based on the crappy film of the same title. Do I even have to tell you it's terrible? Sierra, of course, was an awesome publisher back in the '80s, making classic games of my childhood like "King's Quest," "Space Quest," and (when I got a little older) "Leisure Suit Larry." The first time I remember ever laughing at a videogame was definitely a Sierra title. There's a great Wikipedia entry on Sierra that goes from its founding by Ken and Roberta Williams (who made the first ever adventure game with graphics) through its heyday in the '80s to the corporate machinations in the late '90s and early 2000's and eventually being turned into Vivendi Games' label for everything non-Blizzard. If all goes according to plan, video game publisher Activision Inc.'s "Guitar Hero" will soon be rocking out with avatars of Vivendi SA's "World of Warcraft." Activision said Wednesday that the Delaware Court of Chancery denied the Wayne County Employees' Retirement System's request for a preliminary injunction to halt a shareholder vote relating to Activision's proposal to combine with Vivendi Games Inc., the interactive entertainment business unit of French media conglomerate Vivendi. In February, the Detroit pension fund brought the Suit, claiming directors of Santa Monica, Calif.-based Activision had not obtained the best deal for shareholders. Judge William B. Chandler III ruled that the pension fund failed to show that the additional information it wanted before the meeting was important to investors. Chandler appeared to be well versed in the gaming world and compared it with the world of M&A with references like: "In some ways, perhaps, the world of Mergers and Acquisitions is a massively multi-player role playing game as well. Like in World of Warcraft and other games, the participants in the M&A field take on certain roles, interact in their own community, hone specialized skills, and even develop a unique, somewhat curious vernacular." Fallout of the Activision – Vivendi merger It’s been something to see the merger happen and at whopping approval rate too but now comes the down fall of the merger. As you knew Vivendi games houses a lot of little developers that make good games and for a long time a much waited and hyped game is Ghostbusters the Game by Sierra Entertainment but now it may be in jeopardy. Recently Activision has announced that it’s only interested right now in a few of its game franchises to be pushed and they are Crash Bandicoot, Spyro the Dragon, Ice Age, Prototype, and a yet unnamed game too. So Activision has basically said that games like Brutal Legend, Ghostbusters, Chronicles of Riddick: Assault on Dark Athena, World at Conflict: Soviet Assault, 50 Cent Blood on the Sand, Zombie Wranglers, and Leisure Suit Larry: Box Office Bust have a unclear future and maybe canned for good. It’s understandable that after a merger you would only push the biggest named games or franchises but games like Ghostbusters and Brutal Legend have a cult following that can’t be ignored with many gamers waiting patiently for years for a Ghostbusters game it would seem nuts for Activision Blizzard to ignored that market for Spyro the dragon game wouldn’t it. Vivendi made it clear back in mid-January that another Leisure Suit Larry game was in development. If the news didn't grab your attention, I can't blame you - Larry's previous outing, Magna Cum Laude was refused classification by the OFLC in September of 2004. Not a point in Box Office Bust 's favour, as I'm sure you'll agree. Despite Magna Cum Laude 's fate, and the fact Box Office Bust has yet to be rated , EB Games Australia has preorders going for the new title. Brian Kopp, 24, have filed Suit in March against California-supported Blizzard Entertainment, parent company Vivendi, and the Entertainment Software Association. The complaint questionable that those organizations were wrong to order eBay to terminate auctions of his book The Ultimate World of Warcraft Leveling & Gold Guide, of which he have sold hundreds of copies since last August at most $15 apiece. Alleging the book violated intellectual-property laws, Blizzard, Vivendi, and the ESA sent repeated take-down notices, provided for by the Digital Millennium Copyright Act, to eBay. The sell giant's general policy is to halt auctions when it receives such notices and to suspend a user's statement after it racks up a certain number of warnings. Kopp routinely filed counternotices protesting the claims, according to his original court complaint in California federal court. Because the companies never responded to those documents, eBay was free to reinstate Kopp's auctions, which it did. But the video game industry continued to issue take-down notices, the number of which grew high enough that eBay was forced to suspend Kopp's accounts under multiple usernames.
