A federal judge shut down the websites of a company selling do-it-yourself spyware known as RemoteSpy, following a complaint filed by federal regulators accusing the company of Violating federal fair trade law, the Federal Trade Commission announced Wednesday. The temporary restraining Order and  lawsuit  (.pdf) mark the first time the FTC has targeted the amateur spyware market, where stalkers, jealous spouses and ethically challenged private investigators can buy keylogging software that secretly monitors people's every online move. RemoteSpy runs as a hidden Windows program on the target's computer, recording password, website visits and screenshots and secretly uploading them to RemoteSpy.com, where the purchaser can log-in to see the results. The company described the product as "perfect for those who wish to monitor their computer while they are away," but also touted that it can be remotely installed, according to a cached copy of the CyberSpy Software's website. The Federal Trade Commission alleges that the company provided instructions on how to fool people into installing the spyware by adding it as an innocuous-loking email attachment, including embedding it in a Word document. The complaint asks a Florida federal district Court judge to stop CyberSpy and its CEO Tracer Spence from selling the software, saying it is "likely to cause substantial injury to consumers that cannot be reasonably avoided and is not outweighe ...

Oh, snap. IBM threw scissors after all . In the continuing saga of Mark Papermaster—torn between two worlds—IBM has won the latest round. The company had sued Papermaster, its former employee, for Violating a non-compete agreement in his contract when he went off to work for Steve Jobs’s Magical House of Candy and Wonder. The courts have backed IBM in the immediate future, granting a preliminary injunction that prevents Papermaster from going to work at 1 Infinite Loop while the whole matter is settled. U.S. District Judge Kenneth Karas has told Mr. Papermaster to “immediately cease his employment with Apple Inc. until further Order of this Court.” The big issue at question here is just how enforceable the non-compete clause of a contract is , and the decision in this case could have far-reaching implications. Papermaster is supposed to be starting his job as senior vice president for devices hardware engineering (here’s his bio at Apple , via the magic of Google cache), a post that he snagged after the departure of Tony Fadell . The best defense is a good offense, and Psystar aimed to get all offensive by accusing Apple of Violating antitrust laws . Unfortunately for the boys from Miami, U.S. District Court Judge William Alsup has told Psystar to stick it , dismissing the company’s monopoly allegations against Apple. Alsaup points out that the company can not both have its delectable baked goods and consume them as well: “Indeed, Psystar’s allegations are internally contradictory. Psystar alleges that Mac OS is, by definition, an independent and unique market. Three of the people accused of involvement in a tree-sitting protest against a sports training center at the University of California, Berkeley are facing jail time. Alameda County Superior Court Judge Marshall Whitley sentenced Kingman Lim, Zachary RunningWolf Brown and Michael Schuck to five days in prison Monday and ordered them to pay an amount that has yet to be determined toward the university's attorney fees. The judge sentenced six other people involved in the protest to 50 hours of community service each. The nine people sentenced were accused of Violating a Court Order intended to stop the protest. Federal District Judge Kenneth Karas in White Plains ordered that Mark Papermaster "immediately cease his employment with Apple Inc until further Order of this Court." Apple announced on Tuesday that Papermaster would lead the engineering teams making Apple's highly successful iPods and iPhones and that he would report directly to Chief Executive Steve Jobs. On Friday it said he would cease work for now. In the short term, this probably doesn't have much, if any, effect on Apple. Steve Jobs is the "vision" guy on the iPods and iPhone, and Jonathan Ive is the industrial designer who crafts the look and feel of the devices. But if this drags on for long, I wonder if Apple starts to run into some business problems, such as getting new firmware updates published on schedule or getting new prototypes through FCC approval in time for the annual summertime iPhone refreshes. ...

A paralyzed man who has sued hundreds of businesses over accommodations for the disabled lost his Supreme Court appeal Monday to get out from under a Court Order requiring special permission to file new lawsuits. Jarek Molski has been labeled a "vexatious litigant" by federal courts in California because he has filed roughly 400 lawsuits alleging that restaurants and other businesses are in violation of the federal Americans with Disabilities Act. Molski is paralyzed from the chest down and uses a wheelchair. The justices rejected his case without comment. Molski frequently complains about the lack of handicapped van parking, counters that are too high, narrow doorways and grab-bars installed too high or low in bathrooms. In addition, he often says he was injured in the course of his visit. Targeted business owners often have settled out of Court rather than pay attorneys and take the time to fight the lawsuits. A federal judge in Los Angeles described the lawsuits as extortion. The San Francisco-based 9th U.S. Circuit Court of Appeals upheld the ruling that Molski was an abusive litigant, although it noted that many of the establishments he sued probably were Violating federal law. "On the other hand, the district Court had ample basis to conclude that Molski trumped up his claims of injury," the appeals Court said. The case is Molski v. Evergreen Dynasty Corp., 08-38. ...

The defense in the MySpace hoax trial rested Monday without calling a Missouri mother to testify on her own behalf, instead relying on her tearful daughter to direct blame elsewhere for an Internet ruse that allegedly led to a teenage girl's suicide. The case neared closing arguments with U.S. District Court Judge George Wu yet to rule on a defense motion for dismissal on grounds that Lori Drew, 49, could not be held responsible for Violating the service rules of the MySpace social networking site because there is no proof she ever read them. In comments to lawyers, the judge cited a rule under which he may wait until after a verdict to rule on the motion. "In Order to violate a terms of service intentionally, a person must have actual knowledge of the exact term and then make it her conscious object to violate it," defense attorney Dean Steward wrote in documents filed during the weekend after making his motion last week. Drew has pleaded not guilty to conspiracy and accessing computers without authorization. The American Lung Association sent the regional affiliate a cease-and-desist letter Friday ordering that it stop using the organization's name and turn over its assets because of alleged policy violations that include the chapter's sale of its $3.2 million Seattle headquarters to a newly founded lung organization for $10. The regional affiliate replied Monday that it can't be dissolved pending the outcome of legal claims in King County Superior Court, and that the ugly spat wasn't doing either side any favors. "This is the kind of a dispute between two charitable nonprofits that should have been settled in the family," Laird Harris, chairman-elect of the Northwest affiliate's board, said in a written statement. "(The American Lung Association's) aggressive and destructive decision to pursue the matter in Court and in the media is damaging to our common mission of promoting lung health." A man charged with fatally shooting a minister outside a northern Kentucky church will be held without bond. Frederick Davis, 40, had an initial Court appearance Monday and the case was continued until Nov. 12 for a preliminary hearing, Kenton County Circuit Clerk John Middleton said. Davis was charged with murder, assault, criminal mischief and Violating a protection Order. Police say he killed the Rev. Donald Fairbanks and wounded another man Saturday morning outside Ninth Street Baptist Church in Covington, where the two went to attend a funeral. Davis' attorney, Dennis Alerding Jr., said his client will plead not guilty, but declined to comment further. A California appeals Court affirmed sanctions of almost $44,000 against an IP lawyer last week for informing her client that trade secrets, which the opposing party intended to be filed under seal, were in the Court's public file. A judge has ordered the Justice Department to produce White House memos that provide the legal basis for the Bush administration's post-Sept. 11 warrantless wiretapping program. U.S. District Judge Henry Kennedy Jr. signed an Order Friday requiring the department to produce the memos by the White House legal counsel's office by Nov. 17. He said he will review the memos in private to determine if any information can be released publicly without Violating attorney-client privilege or jeopardizing national security. Kennedy issued his Order in response to lawsuits by civil liberties groups in 2005 after news reports disclosed the wiretapping. The department had argued that the memos were protected attorney-client communications and contain classified information. But Kennedy said that the attorney-client argument was "too vague" and that he would have to look at the documents himself to determine if that argument is valid and also to see if there is information that can be released without endangering national security. An Elk Grove Village man accused of killing his mother and leading police on a high-speed chase has been indicted on first-degree murder and other charges, prosecutors said today at a hearing in the Rolling Meadows branch of Cook County Circuit Court. Jonathan Wood, 39, is accused of beating and strangling his mother, Marilyn Wood, 70, whose body was found Oct. 31 in a storage closet in her home in the 1500 block of White Trail.
