This is about to become a front-page story again, possibly this week. When we last checked in, the Alaska Attorney General had ordered state employees to ignore subpoenas to testify and filed a suit to move the investigation from the legislature to a board made up of Palin appointees. An Alaska judge ruled against both decisions last week. The Court ruled that the legislature had the jurisdiction to investigate this matter and to issue subpoenas as part of that investigation. The AG reversed course yesterday and the seven state employees will now testify. Todd Palin has also agreed to answer written questions. He had no standing as a state employee, and would have been subject to arrest for contempt had he continued to defy the subpoena. The agreement to answer written questions is a compromise worked out with the investigator in the case, and they have to be returned to the investigator by tomorrow. The McCain campaign, through five members of the Alaska legislature, filed a new suit yesterday to stop the probe, but I'd be surprised if the court will change its mind because a handful of Republicans want it stopped. The investigation was launched by a unanimous vote of a bipartisan panel and the courts has already ruled that the legislature has jurisdiction over investigating abuse of office, on top of mountains of precedent in the matter. The Alaska Supreme Court has agreed to hear an emergency appeal from lawyers seeking to shut down the Legislature's Troopergate investigation of Gov. Sarah Palin. Texas-based Liberty Legal Institute and Anchorage attorney Kevin Clarkson, representing the group of anti-investigation legislators, filed the emergency appeal.
