Specifically, the FTC changed its venerable Telemarketing Sales Rule (TSR) to prohibit, as of Sept. 2009, Telemarketing calls that deliver prerecorded messages, unless a consumer has agreed to accept such calls from a given caller/seller. Between now and 2009, telemarketers must provide an obvious, easy and quick way for consumers to opt-out of any call, the FTC said. Firefighters are warning residents about an apparent scam in which residents are asked to leave money at their door. Neither the fire department nor the firefighters’ union is asking for donations, but callers who say they are working on behalf of the firefighters are. “Therefore any calls for donations should be considered a scam,” Deputy Chief William Carrico said in a statement released Monday. A petition for a rule change backfired on the U.S. Telemarketing industry, the Federal Trade Commission said Tuesday.In 2004, the industry asked the FTC to allow prerecorded calls in cases where the business had already established a relationship with the customer.That request garnered 14,000 responses overwhelmingly opposed to the idea, the FTC said in a statement.Answering to those responses, the FTC said Tuesday there would be a rule change. But it was not the one the industry had requested.The new rule bars all prerecorded Telemarketing sales calls unless the telemarketer first has agreed in writing to accept such calls from the seller, the FTC said. ... In response to a wave of consumer complaints, the U.S. Federal Trade Commission has confirmed plans prevent telemarketers from making prerecorded sales calls to customers who have not explicitly agreed to receive such calls. The FTC says it will also require all telemarketers to offer a functional opt-out feature on all prerecorded messages that would allow customers to instantly add themselves to the company’s do-not-call list. These measures will “protect consumers from the annoyance and invasion of prerecorded sales messages that seem to be increasing every day,” according to the Consumer Federation of America’s director of consumer protection, Susan Grant. Representatives of the Telemarketing industry argue that the imposition of this regulation will force companies to use live operators, even for messages to existing customers, thereby increasing administrative costs, which are often passed on the the consumer. “The prerecorded message was an inexpensive way to reach customers and now you’ll have to use operators to reach those customers,” commented Jerry Cerasale, senior vice president of government affairs at the Direct Marketing Association. The FTC rejected these arguments, however, noting that “an overwhelming number of consumers hate prerecorded calls.” Exempt from the new rules (which take effect on September 1) are strictly informational recorded calls, such as those reminding patients of upcoming doctor’s appointments, or ...
