Over 8000 lawsuits and so little time. Florida Big TOBACCO lawyers want to call in fellow Big TOBACCO lawyers from other states to assist in defending the lawsuits filed by injured victims in the "Engle" TOBACCO litigation. Apparently, Big TOBACCO has told their lawyers to call off the vacations and forget the holidays. Why is this noteworthy? Big TOBACCO wants to use lawyers who are NOT licensed in the State of Florida. Through prior experience, it is known that these lawyers will not be subject to ethical regulation by the Florida Bar. In addition, again through prior experience, the Bar associations in which the lawyers are licensed usually take an approach of, "well, the misconduct didn't happen in our state, so we can not exercise jurisdiction over it". So, in the event these lawyers' conduct is ever called into question,the Bar and the courts may lack the power to monitor or discipline them. There is also a practical reason that Big TOBACCO wants to use out of state lawyers. They need to wear down the attorneys who are representing injured victims. Big TOBACCO's "scorched earth" approach to defending cases only works if they can throw legions of lawyers at one case and run the costs up for the plaintiff. Big TOBACCO's defense strategy only works where they can have 10, 20, or 30 lawyers working against 1 or 2 plaintiffs; generating tons of paper and eating up thousands of hours of time.
