On the first Monday in October, the Times editorial page crosses its collective fingers and hopes the U.S. Supreme Court's docket of low-profile cases will mean a relatively apolitical, civil and consensus-seeking year. The page also takes a very non-picturesque look at very real and very non-jolly pirates, and criticizes the penny-wise, multi-million-dollar-foolish Bush administration order that California change the way it tallies illegal immigrants who use a state family planning and health treatment program. California's Family Planning, Access, Care and Treatment Program reduces abortion rates and saves $1.4 billion in welfare and other costs so, of course, the administration can't let that go on. Columnist Gregory Rodriguez calls for a different way of looking at why people are religious, and Cal State Northridge economics Professor Shirley Svorny weighs in on the side of the market in the continuing saga of U.S. health care. The market breeds innovation, Svorny says, and innovation delivers lower costs:For all its faults, America's healthcare sector has its advantages. It produces some of the highest survival rates in the world for cancer and other serious illnesses. Patients generally don't have to wait a year for a hip replacement. Today’s the first day of the Supreme Court’s new term , and President Bush is using the occasion to appear before the Cincinnati Federalist Society. He’s being joined by a coterie of right-wing judicial activists who helped him push hundreds of nominations through the Senate. Among them will be Wendy Long, whose Judicial Confirmation Network just launched a nasty smear campaign against Obama. Bush is taking a victory lap, and you almost can’t blame him. Of all the terrible things that he set out to do, shifting the federal courts far to the right is the only thing he’s achieved. A full one of every three federal judges were appointed by Bush, including Chief Justice Roberts and Justice Alito on the Supreme Court, and they have steadily chipped away at our rights . But Bush couldn’t quite close the deal – the right-wing bloc on the Supreme Court is still one vote short of an unstoppable majority. Justice Stevens – 88 years young and the most progressive member of the Supreme Court – stubbornly refused to retire. Justices Ginsburg and Souter, who have reportedly eyed retirement, also weathered the Bush reign, presumably in hopes of a better political environment next year. What that means is McCain, if elected, stands to achieve Bush’s goal of a right-wing court. Yesterday, Faith Ireland and Robert Utter, two former state Supremes, officially filed suit against the BIAW and said they intend to sue Dino Rossi . They claim Rossi was too hands-on in 2007 with what's supposed to be an independent BIAW PAC. If he, as a candidate, coordinated with the PAC in any way, the PAC would be limited to spending $2,800 on a race they've spent $2 million on in 2008. Rossi says: "If what they were saying were true, which it isn't, there would be no problem with it being true..." Yikes. It's a tough campaign season for the BIAW, which is also being sued by Republican AG Rob McKenna for inappropriate touching of worker's comp funds, among other things. ...
