A local rule limiting the use of a prime-time advertising spot has landed the town in court with a Steakhouse. Bugaboo Creek, located on Caldor Road, has filed suit against Framingham in Middlesex Superior Court over a sign bylaw. The matter centers around an off-premise sign that attracts motorists on Rte. 9 about two-tenths of a mile from the restaurant. A town bylaw called for the sign be taken down since it was not on the same property as Bugaboo Creek. Recent court decisions do not bode well for the restaurant's success in the lawsuit, according to town counsel. The restaurant applied for a temporary restraining order against the town to prevent the sign from coming down. That was denied in court, as was a preliminary injunction, which indicates the claims did not meet legal standards and the court did not think "there was a likelihood of success," in Bugaboo's claims, said Town Counsel Chris Petrini. Some Rte. 30 entrepreneurs received written notice this past spring that the free-standing signs, hung below a Wal-Mart sign at the corner of Caldor Road and Rte. 9, would be taken down by July 1. Of those businesses, so far Bugaboo is the only one to take the town to court over the matter. Should the town prevail in court, it would "reflect that the bylaw is likely to be upheld," in future cases. Presently there is no Bugaboo sign on Rte. 9.
