The Virginia Supreme Court today struck down a state anti-spam law, saying the statute violated the First Amendment right to free and anonymous speech. The decision also tossed out the conviction of a North Carolina man once described as one of the most prolific spammers. The Washington Post's Tom Jackman writes: The ruling, arising from the Loudoun County criminal prosecution of Jeremy Jaynes of Raleigh, N.C., was also remarkable because the Supreme Court reversed itself: Just six months ago, the same court upheld the anti-spam law by a 4-3 margin. I wanted to highlight for you in a ruling in a Spammer case, Jeremy Jaynes v. Commonwealth of Virginia just decided by the Virginia Supreme Court, which struck down Virginia's anti-spam law as unconstitutional. Since the headlines about this story, such as this one in the Washington Post, Virginia AntiSpam Law Overturned, Spammer Walks , naturally point out that a notorious Spammer has avoided jail time as a result, I wanted to make sure you understood the why of it. You can read the entire decision here . I'll highlight the part that matters most. It's a matter of free speech, not because the law should allow spamming, but because the law in Virginia, unlike federal and other state laws, was found to be overbroad, since it blocked religious and political speech too. Virginia's legislature can fix that problem, but a judge can't substantively rewrite laws to make them constitutional. At issue in the case was false headers in emails, and the court significantly decided that the way email works, providing IP addresses and domain name information makes anonymous email impossible, so banning false routing information without narrowing the scope would end up banning constitutionally protected speech as well: For example, were the Federalist Papers just being published today via e-mail, that transmission by Publius would violate the statute. ...

I'm getting some spam on a daily basis. Not much. Most of it is the usual spam for pills/drugs , oem (piracy) software, 419 and alike. Not that much to write about. Today I got one of those that breaks the pattern. Or at least I thought it did, but at first sight I thought it could be one of those dating spams. Bad news for your Inbox: The Virginia Supreme Court struck down an anti-spam law that was used to convict Jeremy Jaynes, a North Carolina man who was was sending 10 million junk e-mails a day. The Supreme Court said that Virginia's law violated the First Amendment and overturned Jaynes' 2004 felony conviction. He was serving a nine-year sentence. Boston (dbTechno) - The Virginia Supreme Court came to the decision that an anti-spam law is unconstitutional, and has let a notorious Spammer, Jeremy Jaynes, walk free. Jeremy Jaynes became, back in 2004, the first person to be convicted of a felony crime for sending spam. Jaynes was found to be guilty of sending out spam e-mails to users over America Online. He would send thousands of e-mails on several different occasions to users. The Virginia Supreme Court ruled though that the anti-spam law is unconstitutional as it violates the First Amendment’s free-speech protection. This is due to the fact that they stated it restricts commercial e-mail, as w ell as unsolicited e-mails. Jaynes was initially sentenced to 9 years in jail for spamming. The ruling will be appealed to the U.S. Supreme Court. ...
