Photo by Michael Alan Goldberg "He's Sick, but he'll be okay." Hold Steady keyboardist Franz Nicolay writes of his laid-up bandmate Tad Kubler in the latest Franznews e-missive. Reassuring news for fans and well-wishers of the rock'n'rollers, for sure, but it comes with an unfortunate caveat: Tad's bout with pancreatitis will keep the band from all of their European dates this month, not just the UK cancellations we mentioned earlier this week. There seems to be a scramble to reschedule as much of the tour as possible, as the Hold Steady have thrown quite a few new UK dates onto their itinerary in early December. In any case, get better, dude. The band's North American plans with the Drive-By Truckers are-- cross those fingers with me now-- still on for the moment. But, with a newly free weekend ahead of him, Nicolay's gonna be spending his Saturday (October 4) at the Goldenrod Campground at the Floyd Bennety Field in Brooklyn, doing a show at something called the "Second Annual Punk-y Camping Trip & Acoustic Show". He promises a few anti-CMJ solo sets later this month, performances in Crimea, and at least one show with Star Fucking Hipsters , but those details are on the way. The Hold Steady's updated itinerary is available after the jump. read more ... Source: www.realityblurred.com --- 37 days ago

The Dallas Morning News has reported a shocking story about long-haul Truckers who are legally disabled yet continuing to drive. These drivers have contributed to many fatal collisions. This story was especially timely to our law firm because two lawyers from our firm are in trial this week in a case in which a driver suffered a heart attack, passed out, and rearended our client. The defendant driver had a history of heart problems, but was endangering the public by continuing to drive. Here are excerpts:Tractor-trailer and bus drivers in the United States have suffered seizures, heart attacks or unconscious spells behind the wheel that led to deadly crashes on highways. Hundreds of thousands of drivers carry commercial licenses even though they also qualify for full federal disability payments, according to a new U.S. safety study obtained by The Associated Press. The problems threatening highway travelers persist despite years of government warnings and hundreds of deaths and injuries blamed on commercial truck and bus drivers who blacked out, collapsed or suffered major health problems behind the wheels of vehicles that can weigh 40 tons or more. The U.S. agency responsible for cracking down on unfit Truckers, the Federal Motor Carrier Safety Administration, acknowledges it hasn't completed any of eight recommendations that U.S. safety regulators have proposed since 2001. I recently wrote a blog about the damage, injuries and fatalities that Sick Truckers are causing on our roadways. Michigan auto accident lawyer Steve M. Gursten recently wrote this informative article about how Michigan has been listed among the top 12 most sanctioned states in the country that allow Truckers with serious medical problems, including seizure disorders, to drive large tractor-trailers. To date, there are no regulations that require truck drivers to carry valid medical certificates. In the article, Gursten gives an example of a client whose husband was killed in a big rig accident . The truck driver, Charles Dreyer, was reportedly suffering from a seizure disorder and took Tegretol, a powerful epilepsy medication that causes drowsiness and delayed reaction time. This alone should have barred Dreyer from driving any type of vehicle on any interstate, but he was allowed to drive a fully-loaded 150,000-pound gravel truck with two trailers in dangerous, out-of-service condition. California is no better when it comes to truck accidents. We rank pretty high on the list of states with the highest number of big rig accidents. In 2006, California had about 12,800 big rig accidents resulting in death or injury, according to the most recent data from the Federal Motor Carrier Safety Administration (FMCSA), which monitors trucking companies. Hundreds and thousands of tractor-trailer and bus drivers carry California licenses despite q ... Source: www.truckingaccidentattorneyblog.com --- 66 days ago
When a driver behind the wheel of an 80,000-pound truck blacks out, goes into a diabetic altered state of consciousness, suffers a seizure or experiences a heart attack, the consequences are deadly. Unfortunately, far too many Sick bus and truck drivers are on the road every day, placing innocent motorists in harm’s way. According to a study released last week by the Government Accountability Office titled, “Commercial Drivers: Certification Process for Drivers with Serious Medical Conditions,” more than half-a-million people with commercial drivers licenses also qualified for federal disability benefits. At least 1,000 drivers were diagnosed with vision, hearing or seizure disorders that should have disqualified them from a commercial license. As the Associated Press points out in “Deadly Tolls: Sick Truckers causing fatal wrecks,” the problem was identified by U.S. safety regulators as far back as 2001. However, a proposal that would have set minimum standards for determining whether truck drivers are medically safe has not been implemented. The cost in terms of lives lost is sobering, as the families of four women who were killed on Interstate 70 near Columbia, Mo., know all too well. In June 2006, trucker George Albright Jr. crashed his tractor-trailer into a Ford sedan and killed the four women inside. He was charged with four counts of second-degree involuntary manslaughter. Last month, jurors acquitted the driver of all of the ... Source: brainandspine.titololawoffice.com --- 79 days ago

Hundreds of thousands of drivers carry commercial licenses even though they also qualify for full federal disability payments, according to a new U.S. safety study. A new study by the Federal Government showed that tractor-trailer and bus drivers in the U.S. suffered seizures, heart attacks or unconscious spells while driving. Many of these drivers should not have been on the road, however, the government has not yet taken steps recommended year ago by safety regulators to ensure that truck and bus drivers are medically fit to operate commercial vehicles.
