A Marlborough man just missed being charged with a felony on Sunday when the items police said he is alleged to have stolen were worth 41 cents less than the $250 threshold. Reginald D. Evans, 43, was charged with his third Shoplifting offense after he was caught stealing a stereo system and a DVD player from Wal-Mart, police spokesman Lt. Paul Shastany said. Police went to Wal-Mart at 4 p.m. for a report of an uncooperative shoplifter. Wal-Mart security said Evans, who was with another man, took the speakers and DVD player out of the boxes, put them in a carriage and left the store, Shastany said. Security guards went after them and caught the men after a short run. They let the second man go because they believed he was not involved in the theft. "(Security) prematurely released this guy," said Shastany. "After looking at the tape, they realized he was involved." The total of the items stolen was $249.59. In Massachusetts, larceny of property worth more than $250 is a felony, while Shoplifting is a misdemeanor. Evans, of 256 Main St., was charged with Shoplifting, a third offense. He was last arrested in Ashland in 2006 for Shoplifting from Payless ShoeSource. Evans was released without bail following his Framingham District Court arraignment yesterday.
