According to a complaint filed Aug. 15 in St. Clair County Circuit Court, the accident happened at approximately 2 p.m. on July 12, 2007. Lewis claims Eye "violently collided" into the rear of her vehicle. Seeking in excess of $50,000 in damages, Lewis claims her back and body were "greatly bruised, crushed and displaced." You can read more about it in my story today, but for all of you wondering about the plywood wall recently erected at Shiloh Bar & Grill, it's because of a little neighborhood noise issue. Shiloh's neighbors, Rick and Kimi Rother, owners of Broadway Physical Therapy across the street, have been complaining to the city and Shiloh's owner, Tom Atkinson, about the noise from bar's patrons on its patio. The Rothers said they have tried talking with Atkinson, but they say to no avail. They turned to the police, who cited the bar twice for violating the noise ordinance. Then came the wall. Atkinson is following his attorney's advice to not say too much. That may be wise advice considering the city could use its new nuisance business ordinance that gives it the power to revoke business licenses of those that repeatedly break city ordinances. Talking to Janice Finley, the city's business services administrator, it doesn't sound like the city has plans to do that, but the police and the city are certainly aware of the situation and are keeping a close eye on it. Atkinson did say the wall is temporary while he finds an acceptable solution to the Rothers' concerns. However, it has been pointed out that the Rothers do live in a downtown area, which tends to be noisier than the 'burbs. Fifth Ward Councilwoman Laura Nauser said perhaps the noise ordinance needs special provisions for the downtown area. And with the city encouraging more mixed- ...
