While recent amendments to the Patent Act have sought to bring our law in conformity with WTO-mandated standards, these amendments have shied from pronouncing conclusively on the patentability of software. Tempers flared at a Public Safety Committee Meeting on Tuesday regarding a decision to approve R.S. Lynch & Company, of Dutchess County, to conduct a report to determine costs associated with building a County Jail. Legislator Joseph Chilelli made a motion to have R.S. Lynch perform a second report, in reference to a previous study by LaBella Associates P.C., of Rochester, on jail needs, such as size, operating costs, and all other relative issues. However, he included a stipulation the report be “not site specific.” Legislator Dennis Korce seconded the motion. The Committee approved the motion by a vote of four yes to two no, with Legislator Vincent J. Bono and Raymond Smith casting in opposition. County Administrator James Wallace vehemently opposed the lack of sites being included in the study as it hindered an ability to deliver overall costs. “We need to give them a site...If we really want an idea of what we’re going to spend,” said Wallace. He explained there is a need to at least request the engineering firm return costs related to specifics involved at “four or five sites” with which the county has been linked. Chilelli argued the important result of the study is determining unknown operating costs, along with establishing an “independent” study.
