If you thought Mac cloners Psystar were going to go on the Apple chopping block without a whole lot of fuss...think again. The case is about to get a lot more interesting now that their defense team seems prepared to play the antitrust card in court. As Colby Springer, one of the lawyers on Psystar's team noted: "This case has been mischaracterized. There are a lot more complicated issues than just copyright or trademark. There are more complex issues [than those] in respect to the end-user licensing agreement. And antitrust issues come into play, too..." When pressed further about the situation in the interview, Springer added: "But take a look at the website of the lead attorney representing Apple," he said. "Apple knows where this is going." I seriously doubt that an antitrust defense will get Psystar off the hook in the end, but it seems to be their best legal option by far. In fact, they probably prepared for this from the beginning. We may have thought, hoped, and dreamed that Apple’s suit against clonemaker Psystar was the end of the story, but the battle will apparently continue in the courtroom this fall. Psystar has retained the services of Silicon Valley law firm Carr & Ferrell to defend its honor. Heading up Psystar’s crack legal team is Carr & Ferrell partner Robert Yorio (pictured), who’s actually taken on Cupertino before in the case of Burst.com v. Apple , where the aforementioned sued Apple for violating its streaming media patents—the case ended with a settlement that saw Apple shell out $10 million to Burst.com. Yorio also oversaw a similar case that ended with a $60 million settlement from Microsoft, a patent infringement case against Iomega and Adaptec, and—perhaps most notably—a case against LEGO for the containers used in their Bionicle line. Yorio’s biggest obstacle will be finding a way around Apple’s EULA, which prohibits installing OS X onto non-Apple branded computers. We’d think it’s a losing battle, but if Psystar somehow manages to eke out a win, this could change the landscape of the desktop market. Once "unauthorized" Apple clone maker, Psystar, was sued by Apple, we fully expected it to challenge the legality of Apple's EULA (end user license agreement) which forbade putting the software on non-Apple hardware (a provision that even Apple has been known to ignore ). The comments to our post suggested that a more likely option would be for Psystar to claim that Apple was violating antitrust laws in requiring the software and hardware be bundled that way. Indeed, it looks like both of those predictions were correct. Psystar's response is likely to focus on both the legality of the EULA and whether or not Apple violated antitrust law . The goofballs that thought it would be a good idea to sell Mac-clones have apparently found an attorney that is as “creative” as they are. Attorneys at Carr & Ferrell (who won the 2006 burst.com lawsuit against Apple) have filled for an extension to the suit, which gives Psystar until August 18th to make a reply to Apple. Both Apple and Psystar agreed to the extension. You may recall that Apple filed the lawsuit in a California court earlier this month, and later demanded that Psystar issue a recall for the Mac clones. When Apple filed the suit, they claimed that Psystar had violated their license agreement and committed copyright infringement by shipping "hackintosh" PCs with Mac OS X 10.5 Leopard. I guess this is for all Apple haters out there. Psystar, or the company selling PC with Mac OS, has called Carr & Ferrell, or the lawyers that already managed to squeeze $10 million from Apple and $60 million from Microsoft in similar cases before, to defend them against Apple, or the company pissed off at Psystar. Well pissed enough to sue Psystar for all they’ve got. So following a logical line of thinking Apple haters will love the fact that Psystar rolls out the big guns. They will love seeing them lose a case in court to Psystar. They will love Psystar and they will love future Psystar PC’s powered by Leopards and other Mac’s cats. They will love Macs, so therefore they will love Apple. So Apple haters will love Apple. Good job Psystar! Personally I don’t think Apple will let this one slip its hands. Loosing such a battle with Psystar will unleash OS anarchy. Every little manufacturer will start tweaking their PCs to work with a Mac OS , and then they will sell them for a cheaper price without an ok from master Apple. That’s what Psystar does and ultimately it will end up changing business. And following my logical line, I guess Microsoft will secretly pray every night Apple wins. They won’t want every little manufacturer to power up their toys with Leopard instead the lovable Vista!
