Cephalon, Inc., a Pennsylvania drug manufacturer, will pay $425 million to settle several lawsuits against it. The lawsuits allege that Cephalon had engaged in illegal marketing of three of its drugs, Actiq, Gabitril and Provigil. Actiq is approved for severe pain in cancer patients whose pain is not controlled by other painkillers. However, Cephalon was promoting Actiq for migraines and injuries. Gabitril was marketed for anxiety and insomnia, though it is approved for treating epilepsy. Cephalon promoted Provigil for fatigue, though its approved use is for narcolepsy. Cephalon encouraged off-label marketing at lavish physician-education conferences and through its compensation and bonus structure, authorities said. The company also had its sales force call on doctors who would not normally prescribe the three drugs, they said. Though FDA approved drugs can be prescribed by doctors for other uses beyond what they were approved for, drug companies are not allowed to promote their drugs for such off-label uses. The Cephalon settlement includes some money to be paid to whistleblowers, who are former Cephalon sales representatives. State and federal Medicaid programs, which paid for many of the prescriptions, will get most of the $425 million. South Dakota will collect nearly $50,000 in a national settlement from a pharmaceutical firm. Cephalon is settling allegations of improper off-label marketing of three pharmaceutical drugs. The federal and state settlement of $425 million dollars resolves allegations that Cephalon promoted the drugs Provigil, Gabitril and Actiq for uses other than what the U.S. Food and Drug Administration approved. Yes, it's true -- the drug that Britney Spears has been toting around in her Southern trash purse will now be available on college campuses.   Provigil, which is used to treat excessive sleepiness or narcolepsy, is being used to keep tech executives awake and now the college set will catch on for those long study sessions and overnighters.   Provigil, also known as Modafinil, has rave reviews from users on the web, claiming that they can stay awake for unfathomable amounts of time with minimal side effects. In terms of effectiveness, Provigil beats out all of its competitors -- caffeine and adderall cannot match up. The manufacturers of Provigil, Cephalon, will stress that the drug should not be abused or used as a sleep replacement; but potential buyers won't be listening to all that malarkey.   If it's good enough for Britney, it's good enough for strung out, stressed college students!   Unfortunately, 20 years down the road when they recall the drug because it has some freak connection with brain tumors, the competitive advantage won't matter. ...

Cephalon will have to pay the state of Connecticut for marketing several of its drugs for uses that were not approved by the FDA. The pharmaceutical company will pay $6.15 million in a settlement agreement reached yesterday. While doctors may use drugs for off-label purposes, the pharmaceutical companies are not allowed to promote or market drugs for uses they are not specifically approved for. Yet, the pharmaceutical companies do it anyway figuring that their risk-reward benefit favors such illegal practices. Until the federal government really cracks down on such illegal practices the drug companies won't stop ignoring the law and making money in an illegal fashion. Cephalon is not the only pharmaceutical company that's been doing this. However, it's the most recent to get caught doing it. In this case involving Cephalon, the state of Connecticut charged that Cephalon was promoting Actiq for nearly any chronic pain while Actiq was only approved for cancer related pain. Another Cephalon drug, Gabitril, was approved by the FDA for epilepsy but the company marketed it for psychiatric isses and neuropathic pain. Provigil, another Cephalon drug, was approved to treat sleep disorders but was aggressively marketed for such off-label uses as multiple sclerosis, depression and adult attention deficit disorder.
