Law Office of Douglas T. Harris, Esq. v. Philadelphia Waterfront Partners, LP, 2008 WL 4291319 (Pa. Super. Sept. 22, 2008) In this case involving breach of fiduciary duty and related claims, plaintiff had requested the Production of certain email and documents maintained on the computers of two individual defendants.  When defendants failed to produce the requested material, plaintiff moved to compel. At the hearing on the motion, defense counsel informed the court that the two computers were inoperable and that technicians were currently working on the computers.  The court pressed defense counsel for an explanation of how the computers were broken, and observed that plaintiff was entitled to the information that had been requested.  When the court asked defense counsel what Order it should enter, defense counsel responded:  “We can produce the computers.”  After the court entered its Order, defendants appealed. Defendants argued that Production of the computers would waive any attorney-client privilege attached to the documents contained thereon and that the plaintiff had never requested Production of the computers themselves, but that the trial court had raised the issue sua sponte. Plaintiff argued that defendants failed to preserve the issue for appeal and waived their claim of privilege by failing to object to the Order at the time it was issued.  Plaintiff noted that defendants had specifically agreed to produce the computers o ...

Surface Technology Systems plc (STS) (LSE: SRTS), a leader in plasma processing technologies used in the manufacturing and packaging of advanced electronic devices, today announced that it has received an Order worth over £2 million from a major manufacturer for Micro-Electro-Mechanical Systems (MEMS) Production equipment. The Order includes multiple Pegasus processing chambers for deep silicon micromachining of MEMS for use in consumer end-products. The Pegasus source offers significantly higher silicon etch rates than other deep reactive ion etch (DRIE) tools currently on the market. STS offers a choice of two cluster platforms for multiple chamber operation; the VPX, which is supplied with one vacuum cassette and up to three process chambers, and the CPX which has two vacuum cassettes and up to four process chambers. John Saunders, CEO of STS said, "We are very excited by this Order, as not only is it one of the largest orders STS has won recently, but it underlines the success of this relatively new product which was launched eight months ago. We feel it also verifies the capability of our new cluster systems to satisfy the requirements of Production customers." David Haynes, STS' Sales & Marketing Director added, "We see this Order as further proof that the major MEMS manufacturers are successfully using or selling their devices for high volume applications such as automotive or consumer products." This new Order increases STS's c ...

Filed under: Cellphones , Handhelds There's no telling what sort of crazy behind-the-scenes negotiations had to take place in Order for our good friend Boy Genius to get his hands on the very first retail T-Mobile-branded BlackBerry 8220 we've seen in the wild -- and let's be honest, the whole unboxing takes on a sexier tone when there's an element of intrigue to it, doesn't it? Mr. Genius flatly pans the thing for having a pair of awful screens and a prototype feel (despite the fact that he's got a final Production unit), so odds are the Bold owners out there aren't going to be throwing fits of jealousy any time soon. To top it off, the contents of the box are about as exciting as flannel underwear (we guess it's cool that RIM saw fit to throw in a pair of headphones), so don't expect too much. At least it'll be available in a few colors , right? Read  |  Permalink  |  Email this  |  Comments ...

When T-Mobile announced that they had sold out of the initial G1 pre-Order and were tripling Production to meet demand , they said that you could still pre-Order a phone through Oct. 21 to receive it at a later date. Unfortunately, it looks like a much later date. If you pre-ordered one after Oct. 3, you'll have to wait until at least Nov. 10 to get your phone. Meaning at this point it's probably better to just line up on launch day if you're dying to get your hands on one as soon as possible and didn't plunk down your money early. Research focuses on how complex systems and products evolve over time. In system design, specifically, we are interested in how future uncertainty and reuse affect large scale projects. Currently, many systems in the aerospace, automotive and other domains are rigid point designs that cannot easily be changed after their initial deployment. We develop quantitative and implementable methods and tools that explicitly consider both changeability and commonality over a system’s lifecycle. Specific examples of such methods are Time-Expanded Decision Networks (TDN), the sensitivity-Design Structure Matrix (sDSM) and the Technology Infusion Analysis (TIA) process. These methods have been implemented in a variety of software tools and have been demonstrated on systems and products of real-world complexity. We emphasize successful adoption in a variety of organizations to solve problems in space exploration, oil and gas exploration and Production, as well as the development of complex electro-mechanical products, among others. Ultimately, we believe that explicitely designing systems for uncertain future conditions and requirements will change the mindset and practice of engineering as we know it today. We call this approach Strategic Engineering. Strategic Engineering is the process of architecting and designing complex systems and products in a way that deliberately accounts for future uncertainty and context in Order to minimize the effects ...

Thanks for your questions, here's what I found out. Both the Intel X38ML Server Board and Intel® Server System SR1520ML (contains two of the X38ML boards in a 1U system with high efficiency power supplies) are still in Production. Due to large-demand, inventory levels of the X38ML board are very low, but additional supply should be available in mid-October. Please work with your distributor to place an Order so that any orders can be filled as quickly as possible. Intel does have supply immediately available of the SR1520ML system. ...

An improv ensemble decides to start improvising as a pizza Order is placed. We will not stop until that pizza is delivered. Very experimental and 41 minutes long. Three performers (four if you count the delivery guy) on the following instruments: bowed guitar, flute, mobile phone, casio concertmate, penny whistle recordaphone (recorder with a tenor sax mouthpiece), cowbell, microphone with distortion, delay and pitch shifter (used on just about everything at some point), vocals, fife, floor drum, guitar, bari sax, tuvan throat vocals, whistling, squeaky door hinge, rainstick, guiro, electronic organ, snapping, saxophone key clicks, bowed cowbell, rockband drumset, and a plastic sack. Phone number and credit card info were altered in post-Production; everything else was captured live. Had to reduce the bitrate drastically to weigh in under 10mb. ...

CarMax Inc. said Wednesday it is laying off more than 600 employees, or about 4 percent of its total work force, as the auto retailer tries to cut costs due to a decline in car and truck sales. The Richmond, Va.-based company said the reductions are in its service operations departments at a majority of its Production superstores, where it reconditions vehicles. The Production superstores make up 60 of the company's 99 retail locations. "Since Memorial Day, we have taken significant steps forward in aligning our costs with current sales levels," said Chief Executive Tom Folliard said in a news release. "Since that time, we have achieved our store staffing objectives in most departments, but it was necessary to make further reductions in service operations in Order to reach these staffing goals." "This was a difficult but necessary decision for us to make." The reductions were part of the company's long-term initiative to decrease costs in the reconditioning area wile maintaining vehicle quality, Folliard said. ...
