AUSTIN Three justices on the Texas Supreme Court agreed with the other six that the state lacked evidence to take boys and little girls from their parents at the Yearning for Zion Ranch. The three believe, however, that the state did act properly when it removed pubescent girls from the ranch near Eldorado. "The record demonstrates that there was evidence to support the trial court's order as it relates to pubescent female children," Justice Harriet O'Neill wrote. Justices Phil Johnson and Don Willett joined O'Neill in partial dissent from the Court's May 29 decision overturning state custody of 468 children taken from the Fundamentalist Church of Jesus Christ of Latter Day Saints Compound. The FLDS, is a breakaway sect of the Mormon church and still practices polygamy. Texas authorities raided the YFZ Ranch after calls were made to a domestic abuse hot line, purportedly from a 16-year-old mother at the ranch who said she was being abused by her middle-age husband. O'Neill wrote that evidence "indicated a pattern or practice of sexual abuse of pubescent girls, and the condoning of such sexual abuse, on the Ranch." She faulted the majority for holding that the Department of Family and Protective Services should have tried other ways to protect the children before taking custody. Dallas lawyer Laura Shockley told a Utah newspaper she is considering filing a civil rights lawsuit against the state of Texas stemming from the April 3 raid of the Polygamist Compound in Eldorado. A spokesman for the Polygamist group, Salt Lake City attorney Rod Parker, also said he is considering a similar lawsuit. "There is a desire and a need for compensation, so I think you will see something come," Parker told the Deseret Morning News . In the meantime, Texas authorities are considering pursuing criminal charges against the sect’s leader, felon Warren Jeffs, and other males who may have participated in underage marriages. Last week, the Polygamist sect said they would no longer conduct underage marriages. But it may be too late to prevent Jeffs and others from getting in further trouble with the law. A spokeswoman from Legal Aid said profits from FLDS Dress would help women to pay for apartments they've been renting since the raid, as they've been instructed to stay away from the Compound until CPS's investigation is complete. Now, despite HBO's best efforts, the FLDS has never had a stellar reputation among the American public. So the obvious question is, Who's going to buy clothing associated with a polygamous sect that may well be perpetuating child rape?
