The job description for a corporate raider is simple: Buy stock in mismanaged companies, and then growl at them until management pays you a lot of money to go away - or you make management go away. Brand reinvention is usually not part of a raider's attack plan, unless you're Nelson Peltz. Peltz, 66, spends hours wandering supermarkets, malls, and fast-food restaurants with his ten children (ages 5 to 45) to get investing ideas, which he later chews over with partners Peter May and son-in-law Ed Garden, who together run Trian, a hedge fund founded in 2005. Filed under: Activist investing When you look at the work of 13-D wielding activist investors, you usually find the following demands repeating themselves over and over: Try to sell the company to a private equity firm or strategic buyer. Buy back stock and/or pay a dividend. Get rid of the current management and/or board of directors. The frequency of these requests has given many activists a reputation -- in my opinion largely undeserved -- as short-term oriented paper shufflers looking to pump up the stock price and move on. Then there's Nelson Peltz, who focuses on that governance-oriented stuff too but is also unique in that he makes very specific comments about marketing: Wendy's isn't playing up its freshness in its advertising, Heinz's ketchup packets weren't good, Tiffany's was too focused on gifts, etc. This fascinating piece in Fortune looks at the investment methodology of this restaurant and branding expert. Unfortunately, Mr. Peltz's publicly-traded company, Triarc (NYSE: TRY ), has been a poor performer of late. In this model, chronic lung disease develops after an infection with a common type of respiratory virus is cleared to only trace levels of noninfectious virus. Chronic inflammatory disease is generally thought to depend on an altered adaptive immune response. However, here we find that this type of disease arises independently of an adaptive immune response and is driven instead by interleukin-13 produced by macrophages that have been stimulated by CD1d-dependent T cell receptor-invariant natural killer T (NKT) cells. This innate immune axis is also activated in the lungs of humans with chronic airway disease due to asthma or COPD. I stopped by the Peltz Gallery on Saturday. She's still there, despite all of condo construction taking place on the block. For what it's worth, we found a parking spot right out front, no problem. So don't let the cranes scare you away. More importantly, the Warrington Colescott show is what you'd absolutely expect: Fascinating, twisted, remarkable. Warrington is a treasure, certainly one of the best artists Wisconsin has ever produced. Billionaire Nelson Peltz recently made news after his Triarc, which owns Arby's, wolfed down the Wendy's hamburger chain. Now he's taken a taste of Starbucks , and the markets are wondering whether the coffee empire will be his next conquest. Shares of the coffee chain have been struggling, with shares ( SBUX/Nasdaq ) down about 40% over the past 12 months. News of the Peltz interest sparked a 3% pop in the stock on Friday. Could it be that Peltz has a turnaround plan percolating in the back of his mind? Consumer are his forté, after all. In addition to Arby's and Wendy's, Peltz holds board seats with H.J. Heinz Co. and Kraft Foods, and has forced Cadbury Schweppes to spin off its soda unit. Actually, a takeover would be a long shot — at least for now. Redneck Sport The sun is burning into my skin on a hot April day in 2006.  The smell and pieces of tire rubber are aimlessly floating through the air.  I have been sitting on this metal bench for 334 laps, and I beginning to get antsy.  My eyes have been glued to the number 9 car since lap one.  The scanner is set to his frequency.  “WOO, good job boys!” comes over the scanner from Kasey Kahne.    My driver just won the Samsung 500 at Texas Motor Speedway, and my love for NASCAR and the number 9 grew even more that day.    “NASCAR is the fastest growing sport in America.”  I have heard this statement on the TV, in the newspaper, and in magazines, but I’ve never understood why other than the fast speed, the wrecks, and the competition (not to mention the tail gate parties before and after the race).  What could possibly attract so many fans to such a redneck sport?   NASCAR can credit its fast growing popularity to its contracts with Fox, TNT, Speed, ESPN, and ESPN 2.  Due to gas prices, more fans stay home to watch the races, and “television ratings are edged higher this year” (Peltz, Jim). Watching the race at home is nothing compared to actually being at the track, but advances in television and technology work towards giving you the feeling and experience of being at the track.  “Internationally, NASCAR races are broadcast in over 150 countries.”  (Wikipedia)  The coveted redneck sport has expanded into the white collar world. ...

Filed under: Activist investing Shares of Starbucks (NASDAQ: SBUX ) were up more than 6% on Friday after Nelson Peltz disclosed a stake of less than 1% in the company. The Wall Street Journal reports that "John Glass, an analyst at Morgan Stanley, said Mr. Peltz could urge Starbucks to cut spending and use more licensing or franchising in opening locations. The money saved from that could go to buying back shares or a larger dividend for shareholders." Perhaps. He very well could urge Starbucks to do that -- but take a quick look at the chart for the company that Mr. Peltz is chairman of -- Triarc (NYSE: TRY ). The stock closed at $6.69 on Friday, after beginning 2007 at more than $20 per share. And how's the corporate governance over there? One company that engaged in a proxy fight with him blasted him with this : Triarc received a corporate governance rating of 21.5, exceeding only 21.5% of all companies in the S&P SmallCap 600 and ranking it in the bottom quartile. Separately, Corporate Library gave Triarc an 'F' on overall board effectiveness -- the lowest possible rating. Most likely Peltz's stake is a nonissue and will lead to no changes. PTC Therapeutics has been on a roll over the last few months. But the biotech hit a loud bump when the New York Times featured the story of one mother's legal fight to gain access to PTC124 for her son, who suffers from Duchenne muscular dystrophy. PTC just inked a $437 million deal with Genzyme  for PTC124, which has demonstrated promising results for treating a segment of the Duchenne MD population. Cheri Gunvalson says that the experimental therapy is her son's last and best hope. But PTC isn't providing the therapy to anyone who isn't in the clinical trial and the boy, who can no longer walk, isn't eligible. Gunvalson is asking for access as part of a compassionate use approach that a number of drug developers have in place, but PTC CEO Stuart Peltz has said that there's been too little experience with the mid-stage therapy to provide it outside of a trial. The Times notes that for many people an experimental drug is their only hope.
