The last thing you need if you're a small business or consumer is for your cellphone carrier to experience what it calls a "catastrophic network failure." But when customers of Payless Cellular, a Southern California company, tried to make calls last week, they couldn't. They were told that their service had been disconnected. When they visited the company's website, they learned that at 10 a.m. last Tuesday, Payless had "experienced a catastrophic network failure which caused an interruption of cellular service." No problem, you say. Phone networks go down from time to time, and then they go back up again an hour or two later. But Payless Cellular was down until Saturday, according to Steve Hodjati, a manager at Cellular Fantasy, a Santa Monica store that sells plans on the Payless network. Hodjati said he didn't know why the network went down or how to contact Payless Cellular. "It was a glitch," he said Friday evening at his store, which was open past its normal business hours, as associates sat on desks looking tired and an older couple tried to get their phone restored. The couple didn't want to comment about Payless Cellular or Cellular Fantasy because they said they were otherwise happy with their experience. But many customers didn't have patience for the four-day glitch. A federal judge in Oregon on Friday reduced by almost 80 percent a jury's $305 million judgment against Collective Brands Inc. in a trademark infringement case. U.S. District Judge Garr King cut the amount to $64.4 million, saying that parts of the judgment awarded in May to Adidas AG were unreasonable and didn't follow the law. King, however, refused Collective Brands' requests for a new trial, upholding the jury's decision that the Topeka-based operator of the Payless ShoeSource and Stride Rite chains violated Adidas' trademarked three-stripe logo when it sold shoes with two or four stripes. Adidas sued Payless ShoeSource Inc. in 2001. Payless changed its name to Collective Brands last year. Matt Rubel, Collective Brands' chief executive, said in a release late Friday that he was pleased the judge had reduced the award to a more "reasonable" amount. A Marlborough man just missed being charged with a felony on Sunday when the items police said he is alleged to have stolen were worth 41 cents less than the $250 threshold. Reginald D. Evans, 43, was charged with his third shoplifting offense after he was caught stealing a stereo system and a DVD player from Wal-Mart, police spokesman Lt. Paul Shastany said. Police went to Wal-Mart at 4 p.m. for a report of an uncooperative shoplifter. Wal-Mart security said Evans, who was with another man, took the speakers and DVD player out of the boxes, put them in a carriage and left the store, Shastany said. Security guards went after them and caught the men after a short run. They let the second man go because they believed he was not involved in the theft. "(Security) prematurely released this guy," said Shastany. "After looking at the tape, they realized he was involved." The total of the items stolen was $249.59. In Massachusetts, larceny of property worth more than $250 is a felony, while shoplifting is a misdemeanor. Evans, of 256 Main St., was charged with shoplifting, a third offense. He was last arrested in Ashland in 2006 for shoplifting from Payless ShoeSource. Evans was released without bail following his Framingham District Court arraignment yesterday.
