The USPTO is developing a Continuing Education for Practitioners (“CEP”) system for on-line delivery of educational materials for Patent practitioners. The goal of this whole business — according to the USPTO — is to increase efficiency, reduce pendency, and improve quality in the Patent process. For now, the USPTO trying out the system in a limited pilot program so we signed up to see what the scoop is. Basically, the CEP program presents brief educational materials concerning recent USPTO rule changes, revised Patent examination guidelines, or the like. The practitioner (that’s us) will have to respond to “verification questions” after reviewing the educational materials. The verification questions are drawn from the training material and the practitioner has access to the educational material while responding to the questions. In other words, the verification questions are designed to verify you have actually viewed the materials instead of playing on-line poker (not that we’d do that, of course); they are not a test of knowledge or skills. According to the literature, the total time spent reviewing the educational materials and responding to verification questions should be approximately one hour. Practitioners would be required to complete one CEP program per year. No fee will be charged to access the training materials (yippee!) and a fee would accrue only for failing to timely complete the training. In going through the on-line ...

On September 30, 2008, the US District Court for the District of Columbia overturned the interpretation of 35 USC § 154 (the statute that prescribes Patent terms) by the United States Patent and Trademark Office (PTO). See Wyeth v. Dudas , No. 07-1492 (D.D.C. September 30, 2008). Section 154(a)(2) establishes a term of 20 years from the day on which a successful Patent application is first filed. Because the clock begins to run on this filing date, and not on the day the Patent is actually granted, the statute grants extensions of Patent terms for (a) certain specified kinds of PTO delay, and (b) whenever the Patent prosecution takes more than three years — regardless of the reason. However, Congress says you can’t double-dip: “To the extent that periods of delay attributable to grounds specified in paragraph (1) overlap, the period of any adjustment granted under this subsection shall not exceed the actual number of days the issuance of the Patent was delayed.” In the present case, Wyeth complained that the PTO has miscounted and deprived them of a portion of the extended term. Section 154(b) provides three guarantees of Patent term: The first is found in subsection (b)(1)(A), the “[g]uarantee of prompt Patent and Trademark Office response.” It provides a one- day extension of Patent term for every day that issuance of a Patent is delayed by a failure of the PTO to comply with various enumerated statutory deadlines: fourteen mon ...

The images (most likely shot of a clay model) show a much tamer production version when compared to the Renault Megan Coupe concept shown at the Geneva Motor Show earlier this year. Sleeker than the 5-door Megane shots leaked a couple weeks ago, the coupe's C-pillar differs most noticeably as the window glass sweeps to a clean point as it meets the rear hatch. The best guess is that the coupe will see a range of engines from 1.4-liters up to 2.0-liters rated between 100 and 160 hp, depending on the model.
