penguin-geek writes "Researchers at Northwestern University have discovered a way to ease the tension between ISPs and P2P users. As we all know, there's been a growing tension between Internet Service Providers (ISPs) and their customers' P2P file-sharing services, and this has driven service providers to forcefully reduce P2P traffic at the expense of unhappy subscribers and the risk of government investigations. Recently, some ISPs have tried to fix the problem through partnerships with certain P2P applications. The Ono project represents an alternative solution: a software service that allows P2P clients to efficiently identify nearby peers, without requiring any kind of cozy relationship between ISPs and P2P users. Using results collected from over 150,000 users, they have found that their system locates peers along paths that have two orders of magnitude lower latency and 30% lower loss rates than those picked at random by BitTorrent, and that these high-quality paths can lead to significant improvements in transfer rates. In challenged settings where peers are overloaded in terms of available bandwidth, Ono provides a 31% average download-rate improvement; in environments with large available bandwidth, Ono increases download rates by 207% on average (and improves median rates by 883%). An article in Ars Technica points to a recent increase in copyright infringement notices being sent to universities. While the Record Industry Association of America (RIAA) claims that it has not changed its procedures, it did note that record labels are constantly improving their ability to detect peer-to-peer traffic used to exchange music files (among many other things). According to the article, George Washington University has received 123 notices in the past week, compared to the usual five to ten. A new law in Spain 86'es P2P networks, bans ISPs from "facillitating filesharing" and imposes a blanket tax on blank media. "The tax will go into a fund which will be shared among copyright holders to compensate for piracy." But, the story goes on, according to a European Commission statement, "The logic of levies would also have to be applied to broadband and infrastructure service providers including telecommunications providers that carry content." Yikes, this bill sounds like it was drafted by the record labels themselves. The scary thing is, for most crazy bits of legislation like this one, there is a bit of public outcry and at least some internet coverage of the badly formed bill as it makes its way into badly formed law. A 31 year old file-sharer escaped prison this morning when he received a heavy fine and a suspended sentence for uploading music and movies. The court refrained from putting the defendant in prison, saying that the music industry needs to take some responsibility for the current situation. After a retrial, a 31 year old man from Linköping, Sweden, was found guilty this morning in the District Court. The court decided that for uploading 4,500 music tracks and 30 movies with the filesharing application Direct Connect, the defendant should receive a heavy fine and a suspended prison sentence. Initially the file-sharer had been accused of uploading around 23,000 music tracks, but Sweden’s Anti-Piracy Agency’s (APB) use of questionable investigative techniques forced the prosecutor to withdraw some of the charges. In its verdict, the Linköping District Court decided that due to the large number of files involved in the case, handing out just fines wasn’t enough, hence the suspended sentence. This situation of sharing many thousands of files at once affects the BitTorrent user a lot less than those using other methods of sharing, which is probably why the music industry prefers to target users using ‘folder sharing’ clients, such as DirectConnect, LimeWire and KaZaA.
