Be careful with Google conspiracy accusations; Matt Cutts might make an example of you. After being accused of blocking anti-Net Neutrality pages on the Progress and Freedom Foundation site, Cutts gloats over data to the contrary on his blog. Brett Glass, via Dan Farber's Interesting People mailing list, discovered only pages on PFF.org's website pertaining to Network Neutrality were flagged by Google as hosting malware. Scheduled witnesses and outspoken citizens both demanded that the FCC stop Internet service providers from favoring any one type of traffic over others. Such calls for "Net Neutrality" are generally popular with tech bloggers, e-companies and pretty much everyone else -- except ISPs like soon-to-be-Dallas-based AT&T. A PC World account of yesterday's hearing explained AT&T's objections : But Robert Quinn, senior vice president for federal regulatory policy at AT&T, asked the FCC to look carefully before regulating how broadband providers can mange their networks. While the FCC has the power to enforce Net Neutrality rules, broadband providers need to be able to manage their networks as more and more subscribers begin to use high-bandwidth applications such as video, he said. AT&T spent about US $17.5 billion in 2007 on expanding networks and other capital improvements, Quinn said. The broadband provider expects bandwidth demand to increase by more than 400 percent in the next three years, he said. "With the kind of growth we are seeing in bandwidth demand today, we cannot simply stay ahead of the bandwidth curve by building bigger and better pipes," Quinn added. "The money to build them just doesn't exist. Network operators must be able to manage those networks to squeeze out every last ounce of efficiency that we can, in order to keep the cost to the end-user customer as affordable as we can possibly make it." Net Neutrality was once the purview of academics and policy wonks who warned about creating "haves" and "have-nots" in a two-tiered Internet world that was decidedly user unfriendly. With the brouhaha over Comcast's network management and Bell Canada's aggressive deep-packet inspection, Net Neutrality has become a hot topic beyond the world of telecommunications companies. It's become--gasp--public. Canadian Radio-Television and Telecommunications Commission chair Konrad von Finckenstein told an industry group last month Net Neutrality "is one of the polarizing issues of the day. It will have to be addressed and debated by all of us." He's on target. Now, businesses--most notably Google--increasingly are jumping into the fray and coming down in a predictable scattering. Those that use the Internet as a pipeline, including Google, Skype, many ISPs, and Internet destinations, are all over Bell and Comcast for threatening the freedom of the Internet. In favor of "network management?" Surprise! The telcos and cable companies that have to deal with keeping the traffic flowing. The NY Times is reporting that the FCC has found that Comcast's aggresive blocking of BitTorrent traffic has violated the FCC's open access rules. What the penalty will be will not be known until August once the full board has met. This ruling sets a fantastic precedent, while every ISP shapes traffic to some extent if they are too aggresive or indiscreet with their actions the FCC will step up and penalise them. Comcast is of course not saying they will stop packet shaping altogether but rather that they will instead experiment with other packet shaping techniques. This ruling does not ban any packet shaping of Internet traffic, in fact it acknowledges that traffic shaping is a valid action for ISPs to take. What it means is that ISPs must detail the techniques they use. ISPs must also show that the shaping is designed to improve traffic flow without targetting any specific group, sites or protocols.
