A few weeks ago, I spoke with Bill Lamson, an attorney for Nebraska Beef , the Omaha meat packer that has had two large recalls this year of Beef linked to two separate E. coli outbreaks, including one that sickened Whole Foods Market customers in two states. I found him to be exceedingly reasonable and pleasant to speak with. At the time, I asked him about the lawsuit that Nebraska Beef had filed against a church in rural Minnesota in connection with a cluster of E. coli illnesses two years ago among more than a dozen parishioners who ate at the same smorgasbord. One woman died and her family is suing Nebraska Beef . During my chat with Lamson, he said that the management of the company wanted to drop the suit against the church and I put that in my story. Well, it turns out that not only has Nebraska Beef not dropped its suit against the church but it is now going after the church ladies who threw the smorgasbord, according to Leatha G. An Albion soybean farmer, Duane Lee, was one of two members of the Nebraska Soybean Board (NSB) who have just completed a five-day trade mission through Japan. Accompanying Lee was Mike Korth, a farmer from Randolph. Lee is an at-large member of the NSB and serves as the board's treasurer. They were accompanied by staff from the U.S. Meat Export Federation's (USMEF) Japan operations and NSB Executive Director Victor Bohuslavsky. According to Bohuslavsky, both Korth and Lee met with key meat buyers as well as Japanese consumers to gain a better understanding of how financial support from the NSB and the soybean industry is used to enhance sales of U.S. Beef and pork in this critical export market. Japan is currently the single largest market for U.S. pork exports when measured by value ($712.3 million in the first half of 2008 -- a 23 percent increase over 2007). It also was the largest market for U.S. Beef before closing in December 2003. Since reopening to Beef from U.S. cattle 20 months of age and younger, Japan has climbed back to being the third-largest Beef export market in terms of value ($177 million in the first half of 2008 -- a 70 percent increase over the same time period last year). According to an International Trade Commission (ITC) report, U.S. Beef producers lost nearly $11 billion between 2004 and 2007 due to barriers on U.S. Beef exports not warranted under the World Animal Health Organization (OIE) guidelines. That statistic is a big cause for concern, said Sen. Ben Nelson, D-Neb., as livestock producers are facing even bigger woes now. The nation's financial meltdown may impact exports, cause a decline in demand domestically and tighten credit markets for producers. Nelson wants the Bush administration to increase its efforts to re-open important foreign markets for U.S. Beef in light of the report. "For years, I have called for greater efforts on the part of USDA and USTR to re-open markets for U.S. Beef worldwide," Nelson said. He said trade restrictions based on perceived health risks and not on sound science are unfair trade barriers and have cost Nebraska Beef producers billions of dollars. "While some progress has been made in Korea, more must be done to restore full and fair trade of U.S. Beef with that important market," he said. "U.S. Beef is the best and safest Beef in the world, and our trading partners shouldn't hide behind trumped-up safety concerns to keep our Beef off of their consumers' tables." While the new country-of-origin labeling law is in effect as of Monday, the battle isn't necessarily over when it comes to giving consumers the complete lowdown of where their food comes from, said John Hansen, president of the Nebraska Farmers Union. "We have come a long ways, but still are not where we want to be," Hansen said. Farmers Union's battle to get a national country-of-origin food labeling law into effect goes back to 1984, with Nebraska Farmers Union being the first farm organization to champion the cause, Hansen said. But while consumers now have label information about where their meat, fruits and vegetables come from, Hansen said the meat industry is still resisting the law. He said USDA has left a loophole in the law that allows packers to label U.S. Beef with a North American label, such as "Product of the U.S., Canada and Mexico," so long as one or more imported animals go through a packer's daily production run. "We are not done with that part of the deal yet," Hansen said, as country-of-origin labeling proponents are still battling the U.S. Department of Agriculture to fix the law the way Congress intended it when it was passed. "We are not going to rest until this law is the way it should be." A USDA Food Safety and Inspection Service (FSIS) investigation of two Nebraska processing plants has revealed E. coli contamination occurred because some production was taking place under unsanitary conditions. There have been over 41 illnesses and dozens of hospitalizations to consumers in Michigan and Ohio. There is also another outbreak emerging in Georgia and health officials are trying to determine if dozens of cases are linked to Michigan and Ohio. The Nebraska Beef Company has recalled all 5.3 million pounds of meat produced for ground Beef between May 16 and June 26, which is ten times the amount in the original recall. The states named in the recall were Nebraska, Colorado, Illinois, Michigan, New York, Pennsylvania and Texas. It's still not clear if any of the contaminated meat was sent to any other states. Nebraska Beef, Ltd., an Omaha, Neb., establishment is expanding its June 30 recall to include all Beef manufacturing trimmings and other products intended for use in raw ground Beef produced between May 16 and June 26, totaling approximately 5.3 million pounds, that may be contaminated with E. coli O157:H7, the U.S. Department of Agriculture's Food Safety and Inspection Service announced today. Although Nebraska agricultural exports are on the rise with a total of $4.6 billion last year, state livestock producers are not seeing the benefits of that expanded trade. According to the U.S. Department of Agriculture, Nebraska's agricultural exports were valued at $4.046 billion, which was fifth in the nation behind California, Iowa, Texas and Illinois. The leading category was feed grains and products at almost $1.27 billion, through livestock in the form of live animals and meat, animal fats and animal hides and skins totaled almost $1.35 billion. And exports continue to be solid, according to the U.S. Meat Export Federation, which reported that U.S. pork and Beef exports were strong in July, as pork exports remain on an all-time record pace for the year and Beef exports are achieving levels of success not seen since 2003. But while Beef and pork exports are up, Bruce Johnson, agriculture economist at the University of Nebraska-Lincoln, Nebraska's livestock sector is expected to experience a $750 million reduction in net earnings compared to 2007 due to higher feed costs. Johnson said 2008 "may be an income-short year that many specialized livestock producers would probably like to forget." He said while livestock revenues are expected to be up $500 million in 2008, the increase will be more than offset by higher feed grain costs, which have risen as much as $700 million.
