Xinhua News is reporting that China's State Council has approved a significant expansion of a "transgenic species development" program to "shore up the country's sustainable agricultural development." Critics of genetic modification may find the idea of "sustainable" transgenics an oxymoron, but China's move is nonetheless a huge story, with enormous implications. Just as the high price of gas is driving Americans to reconsider offshore drilling, the issue of food security appears to be forcing the Chinese government to put genetically modified rice back on the menu. In the West, anti-GM activists are quick to dismiss all claims of improved yields or other positive attributes associated with GM crops as nothing more than Monsanto pulling the propaganda wool over the eyes of browbeaten farmers or coopted governments. But this is China. To paraphrase Deng Xiaoping: "It doesn't matter whether the cat is genetically modified or not, as long as it catches mice." The sun was nearing the horizon as David Brumback left his shop Tuesday night, finishing a day overseeing his 2,800 acre farming operation in southern Cooper County. A fourth generation farmer, Brumback has more to worry about than the unusually wet weather of the past few months and its impact on his crops. Brumback is one of more than 100 other local farmers – many of whom are customers or members of the Pilot Grove Cooperative – who have been named in a Monsanto Co. subpoena requesting five years worth of farm records, including Farm Service Agency reports, and seed, grain and chemical receipts. Brumback calls himself a loyal Monsanto customer and says he believes the company has good products. But he has a number of issues with the request, from the way it was delivered to what it says about Monsanto’s treatment of its customers. Sitting at his kitchen table in a house surrounded by corn fields, he laughs a little as he recalls “fishing” with the investigators who showed up at his shop – set back about a mile down a gravel road off Hwy. 135 – in a Ford Expedition asking for his father. “What do you want with him?” Brumback said he asked. Then anger. “With Monsanto, you’re guilty until you’re proven innocent,” he said. Across rural America, Monsanto is known for aggressive legal efforts to protect its patent. Farmers who save and replant the patented seeds in subsequent growing seasons quickly hear from the company’s lawyers – and almost always lose, or settle out of court before trial. Now Monsanto is raising the stakes against this so-called seed piracy with an unprecedented lawsuit against a farm co-op it accuses of aiding the illegal practice by cleaning seeds for use in future crops. In its May issue, Vanity Fair magazine investigated the methods and tactics being used by Monsanto, the world’s largest and most powerful seed company, against farmers, several of whom were sued for “seed piracy.” Farmers who buy Monsanto’s patented Roundup Ready seeds are required to sign an agreement promising not to save the seed produced after each harvest for re-planting, or to sell the seed to other farmers. This means that farmers must buy new seed every year. Those increased sales, coupled with ballooning sales of its Roundup weed killer, have been a bonanza for Monsanto. This radical departure from age-old practice has created turmoil in farm country. In trying to protect its seeds, Monsanto, the magazine reports, has resorted to intimidation, threats, and long-drawn-out legal battles. In late March, Canadian farmer Percy Schmeiser won a small victory against Monsanto Corporation after a decade-long legal engagement. His struggle began in 1997 when the company sued Schmeiser after the its genetically modified canola plants were discovered growing on Schmeiser's property in Saskatchewan. Schmeiser said the modified canola was blown onto his property from a nearby farm, but Monsanto sued for $400,000, citing patent infringement and failure to pay technology fees. Schmeiser and his wife became international spokespeople for farmer's rights and the fight against genetically modified crops -- but in 2004, Canada's Supreme Court ruled against the Schmeisers, reinforcing Monsanto's patent, but waiving punitive damages. One year later, in 2005, Schmeiser found more of Monsanto's plants on his farm, and after uprooting them billed Monsanto $660 for the labor. The issue landed in small claims court, and Monsanto agreed to pay as long as the Schmeisers didn't discuss the case. The Schmeisers rejected the offer. "There was no way we were going to give up our freedom of speech to a corporation," said Mr. Schmeiser told The Globe & Mail of Toronto. Finally, in March, Monsanto paid the fees with no conditions.
