Limelight Networks has had somewhat of a rough time this past year, beginning with a patent infringement case it lost to Akamai to the tune of $46 million on March 3, 2008. Its stock price dropped 25 percent that day and has yet to recover, but Chief Strategy Officer Mike Gordon said the CDN is much better positioned than people tend to admit. "First, everyone always mentions the Akamai case as a reason to think Limelight isn't performing well or can't get profitable," Gordon said. "But we've put aside the money to fund the damages except for interest, and we won't need to save any more for the damages after Nov.1. You can expect to see total money spent on litigation and other legal costs decrease significantly and we also have reduced our reliance on the patent in question to 11 percent of total revenue." Gordon said the company is optimistic about its status entering 2009, as it continues to see its revenue per customer grow and its many partnerships flourish. As an example, he mentioned Netflix's recent announcements that it would stream videos directly to a variety of devices in the living room, such as Xbox 360s and BluRay players, as a major positive for Limelight. Limelight has an existing relationship with Microsoft, and will handle the incoming streaming to its gaming console, adding to a trend of Limelight increasing revenue per customer into 2009. I used to rent my server from SoftLayer.com and got a 100Mbps uplink port and 2000GB / mo included. I paid about $300/mo for the hardware + bandwidth etc. I was only using around 500GB a month at max but used the high speeds at times. I now own my own server hardware and am interested in colocating it with DefenderHosting but have no clue what 1Mbps means. I am wondering if I will still get the burst-ability and amount of bandwidth per month. My clients will be using bandwidth from all over the world. The majority of the traffic coming from Europe and Northern America (so the traffic is spread out a little over the day, but there are noticeable heavy areas). Dan Rayburn submits: Level 3 (LVLT) announced yesterday that it would be laying off 450 employees in North America or about 8% of its total workforce. While that's not good news for the company as a whole, the company has confirmed that the CDN group is not being affected and none of the cuts are coming from the content delivery markets group.While I expect a lot of the 115 open jobs listed on Level 3's website to disappear, Level 3 is currently looking to fill various positions in the CDN group. As we put the final touches on our Frost & Sullivan report entitled World Video Content Delivery Networks Market , which breaks out CDN video revenue and market share, Level 3 will do between $45-50 million in total CDN revenue this year. While most of that revenue comes from small object delivery and not video, Level 3 is showing some good progress with its video CDN offering. $50 million in revenue for 2008 won't make any impact on Level 3's total company revenue, but it would rank them at number four in the industry based on total CDN revenue behind Akamai (AKAM), Limelight (LLNW) and CDNetworks. Dan Rayburn submits: Lately, I've been getting a bunch of questions asking for the latest news on the Akamai (AKAM) and Limelight Networks (LLNW) patent suit. While there is not much news to talk about, Akamai and Limelight were back in court last month and there is a good chance the judge will issue a ruling by the end of this year. Even if a ruling comes down in the next few weeks, it is unlikely that the judge will reverse the original decision in Akamai's favor and such a ruling would then just result in Limelight filing an appeal. Since the appeal process tends to move a lot faster, we can expect for both sides to be back in court probably by the second quarter of next year. When that happens, details of Limelight's workaround for the Akamai 703 patent will then be detailed and we'll get a lot more information on what exactly Limelight has done to circumvent the patent in their eyes. Dan Rayburn submits: On Monday, in the Eastern District Court of Virginia, the Level 3 (LVLT) and Limelight Networks (LLNW) patent suit got underway. While this is only the start of what is expected to be a long and drawn out legal proceeding, I think Level 3 and Limelight Networks should come to terms and end the suit. As a company, Level 3 is in a very different position today than they were almost two years ago when they first notified Limelight about the patents they control from the SAVVIS acquisition. Two years ago, Level 3's stock price was around $7 and they had a market cap of almost $10 billion. Today, their stock is under a dollar and their market cap is under $2 billion.
