State Sen. James O. Sullivan Jr. (D-Wauwatosa), who is also a lawyer, will have to pay Legal Fees and costs as a result of an appellate decision released Tuesday that found a case to be frivolous. Sullivan, a 2001 graduate of the Marquette University Law School, does not currently have a law license. He said he is not actively practicing law because of his work in the state Legislature. He was licensed at the time he handled the case and the appeal. According to the appellate decision: Sullivan represented Stephen Bartelt, who lives on Milwaukee's northwest side, in a lawsuit brought against Rosen Nissan and Anthony Huntoon of Waukesha. Huntoon purchased three vehicles from Rosen, but he failed to make payments. Rosen threatened to file theft charges against Huntoon if it did not receive a payment of $30,000. Bartelt then lent $30,000 to Huntoon, and Huntoon turned over the money to the dealership. Rosen eventually repossessed the vehicles and kept the $30,000. Nissan also has a separate judgment against Huntoon for $31,607. Shawn Govern, a lawyer for Rosen, did not return a reporter's calls. In his lawsuit, Bartelt contended that Rosen's keeping the money and the vehicles was unjust enrichment. The appellate court found that Bartelt's suit failed to make a valid claim and upheld an order of Milwaukee County Circuit Judge Richard Sankovitz dismissing it.
