Representatives from area hospitals and Law-Enforcement agencies will meet Wednesday morning to discuss what state Law requires regarding blood work on suspected drunken drivers. The closed meeting will be at 10 a.m. at the Winnebago County Criminal Justice Center, 650 W. State Street. Winnebago County State’s Attorney Phil Nicolosi is calling the meeting in response to a disagreement that erupted in the early morning hours of July 28 at Rockford Memorial Hospital when police asked an emergency-room physician to perform a DUI blood kit on an unwilling patient, and the physician refused to comply without a court order. Police were there investigating a fatal DUI accident. The suspected drunken driver was being treated for injuries from the crash. Nicolosi says state Law supports the officer’s request for the man’s blood. Hospital Officials say they need a court order. Nicolosi said he’s keeping the meeting closed to the public and media so Officials can speak freely about their concerns and what happened that night. Members of the local judiciary, the Guam Police Department and the Guam Legislature were able to get an early look at Guam's future crime lab. The new facility will consist of several areas for forensic science testing for firearms, fingerprinting and analysis. Guam Police Department chief Paul Suba says the crime lab will not only benefit GPD, but students attending the University of Guam and the Guam Community College, as well. "People can come and utilize the facility to learn more about the job and become part of the pool to become forensic analysts or scientists," the chief said. Source: Crime & Justice News " Federal Law Enforcement authorities have coupled multi-agency task forces with strategies that once focused on Mafia-era crime syndicates to target national and international gangs, reports the Washingon Times. Some gangs are considered security threats, such as Mara Salvatrucha, or MS-13, with an FBI estimate of 10,000 members in 42 states. For the first time, analysts, agents and prosecutors from various government agencies will work together to try to lower the rate of gang crimes, which include homicides, drug smuggling, rape, prostitution, robbery, home invasions, kidnappings, and carjackings. The Racketeer Influenced and Corrupt Organizations Act (RICO) was enacted in 1970 to fight the Mafia, allowing prosecutors to target 'not just individual members, but leaders of the organization,' said U.S. Attorney Rod. J. Rosenstein in Maryland, where the Law has been used against reputed members of MS-13. Using RICO, Rosenstein said, 'you can have a broader impact on the gang, putting them out of business at least temporarily and, hopefully, longer.' The task forces involved are the Gang Squad, which prosecutes national and international gang members; the National Gang Intelligence Center (NGIC), which analyzes patterns and trends; and the National Gang Targeting, Enforcement & Coordination Center (GangTECC), which develops cases for prosecutors." New York State Law Enforcement Officials announced this week a new campaign to crack down on Driving While Intoxicated or Impaired on New York State roads. The campaign coincides with the national "Drunk Driving. Over the Limit. Under Arrest,"campaign which is scheduled to last until September 2, 2008. The program calls for police agencies throughout New York State to increase the use of saturation patrols and checkpoints in an effort to catch intoxicated and impaired drivers. Readers of this Blog and clients of Tilem & Campbell are reminded of my blog dated March 3, 2008 warning drivers about being arrested even if their Blood Alcohol Limit (BAC) is below the legal limit. Obviously it goes without saying that a driver should never operate a vehicle while intoxicated or impaired by any substance. However, if you are stopped in a DWI check point and you have alcohol on your breath you may be arrested regardless of whether you are legally intoxicated or impaired. Keep in mind that if you refuse to take the breath test your license to operate a vehicle in New York will be revoked for a period of one year regardless of whether you are convicted of DWI or DWAI.
