A criminal investigation into why the CIA destroyed hundreds of hours of videotapes recording harsh interrogations of two Al Qaeda leaders will stretch on at least another six months—and could ultimately result in indictments, according to a recent federal court filing obtained by NEWSWEEK. In his affidavit, John Durham, the veteran federal prosecutor on the case, said he is examining whether anyone "obstructed justice, made false statements, or acted in contempt of court or Congress in connection with the destruction of the videotapes." He said that he is specifically trying to determine whether the destruction of the Tapes violated any judge's order. But progress may be slow. Two sources close to former intelligence officials who are potential key witnesses in the case, both of whom asked for anonymity when discussing the inquiry, said that these officials have not been summoned to give grand-jury testimony; one of them hasn't even been questioned by the FBI yet. ...

It’s the difference between watching a video of someone being interviewed after they have been raped, and watching the actual video of the rape. The following is the CSIS Interrogation video from Guantanamo Bay . These are grown men and women, adults, our representatives in government, questioning a 16 year old child who has been tortured by the US government for a year. The CIA claims that they have destroyed their torture Tapes , but I wouldn’t bet on it. The odds are that there are hours of video showing how Omar Khadr was tortured. I would like to see those videos. I would actually like to see all news stations in the US and Canada broadcast the torture Tapes 24 hours a day 7 days a week for the next year. I think we all deserve to hear the screams of a 15-year-old child being tortured by the most powerful military in the world. And than we can watch as two of the richest nations on this planet defend their actions. Filed under: Bush Administration , Terror In documents filed in Federal District Court yesterday, two CIA officers testified that the agency has found no evidence of deliberate destruction of evidence in the case of a Guantanamo Bay detainee. The Agency has been under fire since late last year for alleged purposeful destruction of videotapes of detainee interrogations. Critics of the Administration's enhanced Interrogation program, in which harsh methods are used against high-value terrorist detainees, say that the destruction of the Tapes was part of a broader effort by the CIA to conceal evidence of torture in the interrogations program. The Bush Administration says that the Tapes were destroyed to protect the identities of CIA officers, whose faces can be seen on them. Lawyers for some of the Guantanamo Bay detainees pounced on the revelation of the Tapes' destruction to claim that evidence on the Tapes may have been useful to their clients in separate lawsuits challenging the conditions of their detention. The detainees alleged that the destruction of Tapes violated a 2005 court order demanding that the government preserve all evidence related to the cases of Guantanamo Bay detainees. Attorneys for a suspected enemy combatant being held in South Carolina say they want any remaining evidence in his case to be preserved, and that Tapes already destroyed would have proven he has been treated harshly while in custody. Tapes destroyed by the government would have shown that Ali al-Marri "was subjected to a brutal Interrogation regime bordering on, if not amounting to torture," his attorneys argued in court documents filed late Monday. The recordings would have supported claims he was subject to sensory and environmental deprivation in the brig, and prevented from participating in religious practices, the documents said. Prosecutors have called al-Marri, a legal resident alien from Qatar arrested in 2001, a national security threat with links to al-Qaida. He has been held in isolation at a Navy brig near Charleston for almost five years. Earlier this year, the Defense Department announced that a review of taping at military prisons found that thousands of recordings were routinely destroyed - including interrogations of al-Marri from 2003 and 2004 that prosecutors said had been considered materials that were no longer needed for intelligence. Prosecutors have said a judge doesn't need to order that evidence be saved because all evidence in ongoing legal cases is already saved under Defense Department directives. The House on Wednesday passed legislation governing next year's intelligence budget that demands lawmakers be given greater access to the nation's most closely held secrets. The bill is the latest attempt by Democrats, struggling to challenge President Bush on major national security issues, to step up their role in overseeing an intelligence program they say has gone astray. Lawmakers complain that the Bush administration left most of them out of the loop on highly classified - and controversial - matters, including creation and destruction of CIA Interrogation Tapes and Bush's warrantless wiretapping program. The bill, which passed on a voice vote, would block two-thirds of the federal covert operations budget until each member of the congressional intelligence committees is briefed on all secret operations under way. Panel members also would be granted access to any other details necessary to assess the value of intelligence operations. The White House has threatened to veto the bill because it says it would go too far and infringe upon the president's right to protect intelligence. In a statement Wednesday, the administration said the bill could expose information previously protected under executive privilege, including pre-decision legal opinions, risk assessments and cost estimates. Doug Feith is set to testify before the House Judiciary Subcommittee on the Constitution, Civil Rights, and Civil Liberties today at 10 AM ET, to discuss Interrogation techniques used on detainees. Feith has a history of not showing up for this Committee , so we'll see how it goes this time around. Phillipe Sands, author of "Torture Team," reported in a recent Vanity Fair article that Feith boasted to him that he was a "real player" in the Guantanamo Interrogation policy. Feith later defended himself, saying he'd been misquoted-- but Sands countered with the Tapes from the interview. Sands will also be before the committee to testify. Khadr is Canada's only prisoner detained by the United States at Guantanamo Bay. At age 17, Khadr was placed in a special program at the camp that intentionally deprived him of sleep, and moved him every 3 hours for 21 days in order to prepare him to speak to government officials. It is reported that the document release is just ahead of a release of video Tapes of the interviews with those government officials that will give the first look at a detainee being questioned at the prison. From the Canadian news The Globe and Mail: "On a number of occasions, the teenager was observed crying uncontrollably, and claiming he was at least partly blind. He removed his shirt to show interviewers bullet wounds, one of them still seeping blood, that he had suffered to his back and stomach during a battle in Afghanistan. The documents show that: Mr. Khadr was subjected to what was known as a "frequent flyer program," which moves a prisoner from cell to cell every three hours 24 hours a day. Under what circumstances would the CIA be required to submit Tapes of their interrogations of terror suspects? I overheard someone at the party say, "Why's it taken so long for a band to come along and pick up where New Order left off?" True, true a fine compliment. The boys are extremely personable and very clear about their situation but they still foolishly allowed themselves to be interviewed by me. Because of the background noise and their thick Australian accents they may have got off lightly during the Moose Interrogation. Two takeaway quotes from the interview for me when I asked them about the internet and the ability to get music into peoples hands were "The powers gone back into the hands of the bands," and "It's time for the labels to try and catch up." Retired general Michael Dunlavey, who supervised Guantánamo for eight months in 2002, tried to locate records on Mohammed al-Qahtani, accused by the US of plotting the 9/11 attacks, but found they had disappeared. The records on al-Qahtani, who was interrogated for 48 days - "were backed up ... after I left, there was a snafu and all was lost", Dunlavey told Philippe Sands QC, who reports the conversation in his book Torture Team, previewed last week by the Guardian. Snafu stands for Situation Normal: All Fucked Up. ..... The CIA admitted last year that it destroyed videotapes of al-Qaida suspects being interrogated at a secret "black site" in Thailand.
