It’s been two weeks since the Senate’s cowardly vote to pass the FISA Amendments Act (FAA), caving in to the president’s demands. With this vote, Congress gave the president virtually all of the spying powers he has sought for so long, and delivered the one thing he demanded above all else: Immunity for his telecom buddies for their role in his illegal spying program. EFF fought long and hard to prevent passage of Immunity for the telecoms, and this vote was a serious setback for our case seeking to hold AT&T and the other telecoms accountable. But the fight is far from over. As we suggested in the immediate aftermath of the vote, Congress may have caved, but EFF has not . The Federal Emergency Management Agency yesterday asked a federal judge to dismiss it from lawsuits filed over the formaldehyde-contaminated trailers provided to families displaced by Hurricane Katrina. Arguing on FEMA's behalf, the Department of Justice told the judge the agency should be entitled to Immunity from claims challenging its response to disasters. Becky Gillette -- director of the Sierra Club's formaldehyde campaign , which first sounded the alarm publicly about high levels of the cancer-causing chemical in the Katrina trailers -- blasted the agency's request, the Jackson Free Press reports : "The government should bear responsibility for harming these people. We tried to tell them early on that these trailers were testing positive for formaldehyde and it took them nearly two years before they even acknowledged a problem," Gillette said. "That’s two years that tens of thousands of families were exposed to excess levels of formaldehyde." Independent tests conducted by the Sierra Club in early 2006 revealed dangerously high levels of formaldehyde in housing provided to Katrina survivors, but FEMA was slow to respond to concerns. In fact, more than a year after the group released its findings, FEMA Administrator R. David Paulison testified before a House committee that he was unaware the trailers posed a health threat. The Foreign Intelligence Surveillance Act ("FISA") grants telecommunications companies, which helped the National Security Agency spy on Americans, retroactive civil Immunity from lawsuits According to the New York Times, "the new FISA bill clarifies the scope of government intelligence activities, depending on the type and origin of the communication, and provides greater latitude to use technology to track foreign terrorism suspects overseas." The new version of the bill still requires a warrant to track Americans in the U.S., but does not require permission to track foreign citizens who are oversees, regardless of whether the surveillance passes through domestic-based communication networks. "If the overseas target is a U.S. citizen, a warrant would be required -- regardless of where and how the spying takes place." There have been multiple attempts over the past three years to revise the FISA bill. Sens. Russ Feingold (D-WI) and Chris Dodd (D-CT) co-sponsored an amendment to FISA that would have eliminated the retroactive Immunity provision from the bill. However, this, and two other modified bills were defeated on Wednesday. Instead, the Senate approved the FISA update by a 69-28 vote.
