The Guardian seems to think so : A coalition of human rights lawyers, academics and leading non-governmental organisations (NGOs) has begun openly to criticise the competence and conduct of the Prosecutor of the international criminal court, the Argentinian Luis Moreno-Ocampo. Their concerns follow his announcement last month that it is to seek an arrest warrant for genocide against the Sudanese president, and the collapse of the five-year-old court's first trial. Supporters of the court fear that Moreno-Ocampo's style of management is damaging the court's credibility and its ability to prosecute those responsible for crimes against humanity. He has been accused of alienating senior staff and seriously misreading the situation in Sudan. One academic has called for the court to consider removing him. The concerns have been compounded by the way in which Moreno-Ocampo dismissed his media adviser, who made a complaint against him of sexual misconduct with a South African female journalist. That complaint, denied by Moreno-Ocampo and the woman involved, was dismissed by the court as "manifestly unfounded". But last month the adviser, Christian Palme, was awarded two years' salary as compensation for wrongful dismissal and €25,000 (£19,700) in moral damages by a tribunal of the International Labour Organisation. [JURIST] Attorneys representing the Georgian Republic appeared before the International Court of Justice (ICJ) Monday seeking emergency orders to stop the alleged killing and mass displacement of citizens in the breakaway regions of South Ossetia and Abkhazia. Georgia argued in opening statements that Russia is engaged in ethnic cleansing, while Russia countered that its military actions have saved lives. The 15-judge court will consider whether it has jurisdiction over the case, which Georgia instituted last month, and whether emergency measures are warranted. Georgia accuses Russia of violating the 1965 Convention on the Elimination of All Forms of Racial Discrimination by removing ethnic Georgians from the territories. The former Soviet republic is seeking an ICJ order that Russia pay compensation, withdraw its troops and allow displaced ethnic Georgians to return home. The ICJ hearings continue through Wednesday. [JURIST] The Extraordinary Chambers in the Courts of Cambodia (ECCC) last Friday ended the segregation of five defendants currently in pretrial detention. The decision, released to the public on Wednesday, was a response to an appeal filed by defendant Nuon Chea, who argued that the prison conditions were too restrictive. In May 2008, the Pre-Trial Chamber approved the strict separation between the detainees, taking away the right to communicate among themselves. The judges at that time relied on ECCC Internal Rule 55, which gives judges the jurisdiction to limit contact between the detainees in the interest of the investigation. They also cited the International Criminal Court (ICC) holding in Prosecutor v. Katanga and Chui, where the ICC ruled: to restrict the communication and the contact...constitute an important restriction of the rights provided for by the detention regime set forth in the Regulations and the RoR, and therefore they can be imposed if the requirements of necessity and proportionality are met. In overturning the segregation order, the Pre-Trial Chamber found that the potential for prejudicial collusion was now negligible, and that there can be no reason related to investigation purposes justifying that contacts between be restricted.
