It’s looking like Lehman Brothers may not be able to count on the federal government for any help in its hour of need and that has all of Wall Street shaking. Shares of Lehman sunk deeper into penny stock territory on Friday, as the beleaguered firm races to find another bank to buy it in a bid to stave-off an imminent collapse of the historic 158-year-old firm. In early Friday trading, Lehman’s stock fell 10% to $3.80, continuing a downward death spiral that began Sept. 8. Now that Wall Street has concluded Lehman CEO Dick Fuld won’t be able to pull-off his previously announced plan for shoring-up the investment firm’s balance sheet, it’s pretty much become a race against time for Fuld to find a buyer—at any price—for the firm. The speculation on Wall Street is that Bank of America, Barclays and consortium of private equity firms are the most interested suitors. But it’s not clear if any of those potential Buyers will want to do a deal with Fuld, as long as the acquirer must also take on some $30 billion in rotting commercial real estate assets that Fuld was planning to unload. Any person who has been committed to mental health treatment and deemed a threat by the courts would be barred from buying a Gun under a proposal approved by the Senate Thursday. The measure, which was unanimously approved, would require court clerks to report to a federal database the names of all people who have been involuntarily committed by the courts to inpatient or outpatient mental health treatment. The National Instant Criminal Background Check, or NICS, is used by Gun vendors to conduct background checks on would-be Buyers. Those listed are barred from purchasing weapons. But a provision pushed by Senate Minority Leader Phil Berger, R-Rockingham, limited the scope of the mandate by specifying that only people who have been deemed a threat to themselves or others would be reported to that FBI-maintained database. "We need to make sure that when we're dealing with people's Constitutional rights ... (that) we are carefully crafting the legislation to meet the problem," Berger said when arguing for the change. "The language in the bill that would have every involuntary commitment - whether inpatient or outpatient - for those individuals to automatically be reported and ineligible to acquire a firearm, reaches too far." Berger's amendment was approved on a 31-18 vote, after a sometimes-heated debate where opponents urged lawmakers to err on the side of caution. The iconic Hummer brand could soon be in the hands of Eastern Europeans. Reuters is reporting that General Motors , which markets civilian vehicles under the Hummer brand has been in talks with Russia's richest man, Oleg Deripaska, to sell the brand. Separately, sources have told Businessweek that Indian automaker Mahindra and Mahindra , as well as a Turkish private equity group have also inquired about buying the brand. GM announced last June that it was evaluating the future of Hummer, which is code for seeking Buyers. GM is hurting for enough cash to see it through its current woes and economic downturn in the U.S. It lost more than $15 billion in the second quarter alone. Hummer, when gasoline was $2.00 a gallon and less, quickly became a hot brand, especially among a certain consumer that gravitates to Gun culture, off-roading and adventure vacations. According to GM, the Hummer H2, when it launched in 2002, was a vehicle that many wealthy households would buy as a third, fourth or fifth car. We read the horror stories everyday on Active Rain about REO agents who don't answer their phones or return emails. Yet fortunately every once in a while we run into an agent who exudes true professionalism and it reminds you of how real estate deals are supposed to go. This morning my Buyers and I went to closing on an REO property in West Springfield . When I saw the name of the listing agent on the MLS I thought this is a name I know from Active Rain, Stacy Magid of Coldwell Banker Elite . When I submitted the offer I told her we were under the Gun to get a ratified contract as my Buyers were working with a relocation company. Even though she thought the bank would take days to get back to us, we had incredibly fast responses from the asset manager and though we had some small glitches, okay maybe not so small, along the way we ended up closing THREE days early! Our first glitch was the day the Buyers, a home inspector and I opened up the door to hear the sound of running water. If there had been a camera on you would have seen 4 adults slowly creeping into a house, eyes darting about, looking for the source of the running water.
