Former Attorney General Alberto R. Gonzales failed to keep classified documents in a secure location in his Alexandria home, claiming that he simply "couldn't remember the combination" on a in-home safe three years ago. Instead, the documents, which contained "top secret" information about the now much-discussed warrantless wiretapping program and detainee interrogations, according to a report released yesterday, were placed in his briefcase or elsewhere in his home. The case was not referred for prosecution and the information was not deemed "a close call," in terms of potentially being lost or stolen, reports The Post's Carrie Johnson. But the episode further highlights some of the more notable memory gaps of Gonzales' tenure as attorney general. In April 2007, during testimony in front of the Senate Judiciary Committee, Gonzales sidestepped 71 questions, saying he couldn't remember details, according to a count by The Associated Press. Before Monday's report on the firing of nine U.S. attorneys, Alberto R. Gonzales was forgotten and gone. He's back in the news with a finding by two Justice Department watchdogs that the former attorney general (and his deputy)  “abdicated their responsibility to safeguard the integrity and independence of the department…” Gonzales' AWOL management style was perhaps not foreseeable in 2005 when he went before the U.S. Senate for confirmation hearings. But other problematic qualities were obvious -- notably his chumminess with George W. Bush going back to Texas and his compliant attitude toward cutting corners in the war on terror. So how did he win confirmation on a 60-36 vote ? One clue came in the opening statement of Sen. Arlen Specter, the chairman of the Judiciary Committee in charge of Gonzales' confirmation: "Judge Gonzales comes to this nomination with a very distinguished career; really a Horatio Alger story. Hispanic background , of seven siblings, the first to go to college, attended the Air Force Academy for two years and then received degrees from Rice and Harvard Law School" (emphasis added). In March 2004, White House Counsel Alberto Gonzales made a now-famous late-night visit to the hospital room of Attorney General John Ashcroft, seeking to get Ashcroft to sign a certification stating that the Bush administration’s warrantless wiretapping program was legal. Deputy Attorney General James B. Comey has said that he believes that Gonzales and White House Chief of Staff Andrew Card, who accompanied Gonzales to Ashcroft’s hospital room, were trying to take advantage of Ashcroft’s grievously ill state—pressing him to sign the certification possibly without even comprehending what he was doing—and in the process authorize a government surveillance program which both Ashcroft and the Justice Department had concluded was of questionable legality. The fact that a prosecutor has been named to continue the investigation into the firing of nine U.S. attorneys doesn't seem to faze former Attorney General Alberto Gonzales, who issued a statement yesterday expressing relief that the process was over. "My family and I are glad to have the investigation of my conduct in this matter behind us, and we look forward to moving on to new challenges," Gonzales said in a statement yesterday. But the investigation, led by the Department of Justice's Inspector General and the Office of Professional Responsibility might be far from "behind" Gonzales. Yesterday, Attorney General Michael Mukasey named Nora Dannehy , a Connecticut interim U.S. attorney, as a prosecutor in the firings. At the IG report's behest, Dannehy will continue the investigation and work of the OIG and OPR offices, but with the power to compel testimony. Nevertheless, Gonzales and his attorney, George J. Terwilliger III seem to be operating in a cloud of denial. The investigation "is clearly over as to him," Terwilliger is quoted as saying in the New York Times . "The inspector general after 18 months of investigation has basically concluded that the facts and circumstances regarding Judge Gonzales's activity do not include any unlawful conduct." ...

We noted yesterday that the Justice Department Office of the Inspector General issued a report on the found that former Attorney Gen. Alberto Gonzales had mishandled classified documents during his time in office -- and that the DOJ had decided not to press charges. But that doesn't seem to be half as bad as what CQ Politics ' Jeff Stein dug up -- fact checking Gonzales' testimony to investigators with . . . well, the report's own stipulated facts. From CQ Politics' SpyTalk : But the IG report shows that Gonzales did more than "mishandle" his notes, which included operational details on what he himself, somewhat ironically, called -- after it had leaked -- "one of the most highly protected [programs] in the United States ... a very, very secretive, protected program," and correspondence between congressional Intelligence Committee leaders and CIA chief Gen. Michael Hayden. In a statement that doesn't pass the laugh test, Gonzales told IG investigators he didn't know the documents were secret. Gonzales said that he was unaware of the classification level and compartmented nature of the NSA program he referenced in the notes. Gonzales also stated he did not recall thinking that the notes themselves were classified. But the IG found the smoking gun -- in Gonzales's hand, no less.
