In the past few months, there has been a rising chorus over the practice of used games. On the anti- side are publishers and developers, who see the practice as taking money out of their pockets through the cannibalization of new Game Sales, while on the other side are retailers like Gamestop, who make higher margins on used games Sales. And with traditional retailers dipping their foot into the used games market (e.g., Circuit City and Best Buy) while increasingly recession-burdened gamers increasingly looking to used games for their fix, are the fears of publishers and developers justified? The selling of used games are a perfectly legal right of gamers under the 'first-sale doctrine' of copyright law, where the purchaser has the right to dispose (i.e., sell, trade, donate, etc.) of a copyrighted work as long as no additional copies are made. In other words, the original copyright holder's rights to control the ownership of the copyrighted work ends with the first sale, and the purchaser has every right to sell it to another buyer, as they would with a piece of used furniture. Similarly, the second purchaser of the copyrighted work (e.g., a used Game store) has every right to sell it to another buyer, and so on. According to research & consultancy firm OTX, the used software market in the US is estimated to be $1.3 B USD in size. NPD reported that U.S. retail Sales of video Game hardware, software and accessories rose only 9% in August which is much less than July's 28% growth rate. If you think this stock won't be rising too far in the coming months, then it could be a good time to look at a bearish hedged play on GME. This morning, GME opened at $42.08. So far today the stock has hit a low of $40.41 and a high of $42.08. As of 12:35, GME is trading at $41.32, down $1.38 (-3.2%). The chart for GME looks bullish and S&P gives GME a positive 5 STARS (out of 5) strong buy ranking. For a bearish hedged play on this stock, I would consider an October bear-call credit spread above the $50 range. A bear-call credit spread is an options position that combines the purchase and sale of call options to hedge risk in case the stock doesn't do what you think but still leverage nice returns. For this particular trade, we will make a 4.2% return in 5 weeks as long as GME is below $50 at October expiration. GameStop would have to rise by more than 21% before we would start to lose money. As the 2008 holiday season approaches, the gaming industry is gearing to get under the tree and analysts are predicting August's single-digit Sales growth is no indication of what to expect for the holiday season. Analysts predicted the gaming industry would begin to slow down during the summer months and they did, according to NPD Group, a research firm based in New York. But that will not hurt the bottom line. The gaming industry's massive double-digits growth over the year had to slow eventually. August saw an increase of only 9 percent in video-Game Sales from August 2007, but analysts say single-digit growth in August is okay. Summer Slowdown "It's not a big deal," said David Riley, a spokesperson for NPD Group. "The summer months are historically the slowest months in the industry in terms of Sales. The industry historically has followed the seasonality trends." In the summer months consumers are busy doing other things like vacationing and playing outdoors and are not normally in front of the television, according to Riley. Retailers in the U.S. cashed in on $1.08 billion in video-Game Sales for August, compared to $995 million the same month in 2007.
