"RFID technology provides obvious benefits, the FTC said. The Federal Trade Commission amended four CAN-SPAM Act provisions. The new rules stipulate that companies don't charge users to opt-out of receiving e-mails. They also alter the definition of the term "person," according to the FTC press release , "to clarify that CAN-SPAM’s obligations are not limited to natural persons." The term "sender" was also redefined in an effort to clarify who's responsible for enabling opt-outs when multiple parties advertise in a single e-mail. According to the Act's full document : The final Rule provides that multiple 'senders' of a commercial email, under certain conditions, may identify one among them as the 'sender' who will be deemed the sole 'sender' of the message (the 'designated sender'). Thus, under the final Rule, the designated sender, but not the other marketers using the same email message, must honor opt-out requests made by recipients of the message. Moreover, under the final Rule, the physical address of the designated sender, but not the addresses of the other marketers using the same email message, must appear in the message. Apparently, the FTC received nearly 60 comments regarding this proposal. ...

At the request of the Federal Trade Commission, a federal court in Illinois has entered a final order and default judgment against a group of individual and corporate defendants based in Ontario, Canada, for their role in a cross-border telemarketing scheme involving credit card offers and free cellular telephone offers. The defendants, collectively known as Pacific Liberty, are liable for about $5 million -- the total net sales they made. The case was brought with the help of the U.S. Postal Inspection Service and the Toronto Strategic Partnership, which consists of the FTC, Competition Bureau Canada and various law enforcement agencies. Canadian regulators filed criminal charges against two of the defendants in September 2007. One got a year in jail and another received a six-month conditional sentence. The Federal Trade Commission is revising its "Green Guides" for environmental marketing claims and courts have held that FTC guidelines should be given weight in determining whether a defendant's marketing claims are false or misleading. The FTC will host a town hall meeting this week to explore the mobile marketplace and its implications for consumer protection policy. Industry experts, academics, consumer advocates, privacy professionals and government analysts will discuss the use of text messaging and related services as instruments of commerce and consumers' ability to control mobile applications at the two-day event, which begins Tuesday. Other topics include the adaptation of advertising to mobile devices (including challenges presented by small screen disclosures); applications targeting children and teens; industry best practices in preventing fraud, disclosing costs, and resolving billing disputes; security threats and solutions; and next-generation products and services. His breakfast speech to members of the Computer and Communications Industry Association on Wednesday was packed with athletic imagery.
