by John McNeill KALAMAZOO -- Kalamazoo’s Public Safety Department may be turning over a new leaf, but it won’t be able to escape its past entirely. A $5-Million dollar lawsuit has just been filed alleging police brutality in a now famous incident. Julia Frank has been trying to get help for her adoptive son for a long time. Now 16, Michael Goldman has lived with Frank since he was two weeks old. She says he's been trouble for most of that time. He was finally diagnosed as mentally retarded six years ago. His growing rap sheet eventually led to his arrest last March; then his teeth were accidentally knocked out when an officer slammed him against a wall. The officer was punished and transferred, but Frank doesn't think justice has been served. Her Attorney Arnold Reed, says Goldman's story isn't unique. They filed suit in federal court on Monday against the officer, the Public Safety Department and the City of Kalamazoo. It seeks five million dollars in damages, and seeks to allow Frank to maintain custody over Goldman. Attorney Reed, a high profile Farmington Hills trial lawyer with some big cases on his resume, filed the lawsuit Monday. Reed claims if they win the money, except his fee, will go into a trust fund to help the boy. The teen is currently at the Edgewater Treatment facility in Grand Rapids. ...

          In a recent federal case called Buckley v. Haddock , the Eleventh Circuit Court of Appeals was asked to decide whether a deputy sheriff's repeated use of a taser gun while trying to arrest a motorist by the side of the road in Washington County, Florida constituted Excessive use of Force in violation of the Fourth Amendment to the United States Constitution .  In ruling that the deputy did not use Excessive Force, the Court stated:           "Needless to say, officers acting alone may not always use any and all Force necessary to complete an arrest without assistance.  If Deputy Rackard had used more severe techniques (beaten [the motorist's] head with a club or shot him, for example), this case would be a different case.  Here, the record shows that Deputy Rackard only used moderate, non-lethal Force; and he did so only after reasoning with [the motorist], then after trying to lift [the motorist], and finally after repeatedly warning [the motorist]-a warning given before each use of the taser-that a taser would be used. In short, Deputy Rackard gave [the motorist] ample warning and opportunity to cease resisting before the deputy resorted gradually to more forceful measures. Mike Means of the Adult Detention Advisory Committee says the jail is an albatross that was poorly designed and has never met the county's needs. For a country known in the West for its historic — and more often fictional — ninjas and samurai, Japan hardly has a strong military. In fact, Japan’s defense ministry recently announced that suicides in the Japanese armed forces are on the rise. This reflects, among other things, low morale in the ranks and the relatively low respect that the Japanese accord their armed forces. During World War II, Japanese soldiers were killing themselves out of Excessive pride in their military traditions. Today, they may perhaps be doing it because of a lack of military traditions. The Times Peter Goodman has a very good piece today about Alan Greenspan's role in the financial meltdown--particularly his efforts to beat back derivatives regulation. The most striking thing about the piece is how blinded Greenspan was by either a simple-minded or deeply ideological faith in markets. His various attempts at self-defense all have a stranglely circular logic. On the one hand, he strenuously opposed regulation because, in his view, people always obey their self-interest, and it's not in their interest to take Excessive risks: A professed libertarian, he counted among his formative influences the novelist Ayn Rand , who portrayed collective power as an evil Force set against the enlightened self-interest of individuals. In turn, he showed a resolute faith that those participating in financial markets would act responsibly.
