Chest. 2008 Aug;134(2):417-24 Authors: Aulisio MP, Arnold RM This article addresses two basic questions about Ethics committees: why we have them, and how they might be helpful to clinicians. Our answer to the first question is twofold. First, we suggest that legal, regulatory, and professional forces drove the development of Ethics committees, particularly as an alternative to litigation. Second, we argue that Ethics committees arose in response to a clinical need for a formal mechanism to address some of the value conflicts and uncertainties that arise in contemporary health-care settings. We argue that this need, reflected in early high-profile legal cases, stems partly from the complex value-laden nature of clinical decision making, a pluralistic societal context, a growing recognition of the rights of individuals to live by their values, and the relevance of those values for medical decision making. In answer to the second question, we draw out three ways Ethics committees might be helpful to clinicians: education, policy formation or review, and consultation. Gov. David Paterson and legislative leaders may be taking a wait-and-see approach on a pre-general election return to Albany, but one group of lawmakers is spending quite a bit of time shuttling to and from the Capitol these days: Members of the Assembly Ethics Committee. Committee Chairman Bill Magnarelli just noticed the next meeting, which at this point could be on any one - or all - of three lawmakers : Tony Seminerio, Sam Hoyt and Greg Ball. Of course, since they meet in secret and are barred from speaking publicly about their deliberations, we have no way of knowing that the Committee members plan to discuss. And unless the Committee issues a formal report on one of more of these lawmakers, we may never know. While the House of Representatives voted against a measure to strip Representative Charles Rangel of chairing the House Ways and Means Committee, House leaders are planning an investigation of Rangel's ethical issues--you know, the lack of reporting income on his returns , his r ent-stabilized apartments , using House letterhead to solicit donations for a center being built in his name. This comes as his 1972 Mercedes Benz, long unused, was towed from a House parking garage ! Yesterday the Post reported that the Benz was covered by a tarp (its NY State registration expired in 2004) and had been there for years. The Post found "House rules forbid use of the garage for long-term storage more than 45 days," and suggests that the free space should have been reported as "imputed income." Rangel only said, "I told you I am not discussing that. I want to be kind and gentle -- please let me be." But he also wrote an open letter , "blaming Republicans and the media" for his troubles. The NY Times reports that Rangel chose to "ride out the storm" and not cede his chairmanship because there are other House Republicans--under actual criminal investigations--who haven't resigned as chairs of their committees.
