California should join the National Popular Vote movement, which seeks to reform the presidential election system. Thanks to the Electoral College, the United States holds elections in which the candidate who wins the most votes doesn't always win the presidency. Voters in some states matter much more than others, so candidates are encouraged to ignore the concerns of the less important ones and focus on those who really make a difference. With seven new state polls out since last week's edition of Battle for the Electoral College, Barack Obama now leads The Hotline 's tabulation with 327 EVs to John McCain's 211; on 8/28 , Obama led 330 EVs to 208 EVs. The 3 EV shift in this week's update stems from an internal McCain camp poll of AK RVs taken 9/2, after the announcement of Sarah Palin as his VP nominee. McCain/Palin's 24% lead in the American Viewpoint (R) poll shifts AK from lean Obama to solid McCain, extending his solid EV total. Obama, however, also added solid EVs this week, and McCain now leads the category 157-149. One week ago, McCain led solids 154-142 EVs. Obama's additional EVs came from the second IA poll available, which shifted its 7 EVs from lean Obama to solid Obama. The CNN/ Time /Opinion Research Corp. survey, released 9/3 in conjunction with MN and OH data, showed Obama/ Joe Biden leading McCain/Palin 55-40% in IA. In MN and OH, Obama/Biden led by 12% and 2%, respectively, which confirmed the states as solid and lean Obama. Meanwhile in NC, a new Democracy Corps (D) poll by Greenberg Quinlan Rosner (D) released 9/3 showed McCain leading Obama 47-44%, with Bob Barr at 4%. Previously, McCain led a Civitas Institute (R)/Tel Opinion Research (R) NC poll by 6%. It's been an uphill battle. Barack Obama would seem to have everything on his side. He's on the right side of the war, the economy, and the energy crisis. He is much more articulate in speaking. Even his opponent has shown him in great light in TV ads. And yet, Obama hasn't been as strong in national polls as you would expect. Yes in state polls, especially in crucial states, Obama is still ahead in polls. But the dominating force of the MSM, who is clearly pulling for John McCain, is rearing its ugly head. We have had instances of the MSM protecting McCain from looking even more the fool (e.g., Katie Couric among others). And there is one more factor: Democrats don't have the benefit of the doubt. There was a time before Richard Nixon where the Democratic candidate for president, House and Senate races all had the benefit of the doubt. They weren't attacked maliciously by the media (though the media was different then as well). Even in this race, Obama has to be the one to prove himself. The MSM about McCain: "Well, we already know he knows foreign policy. We already know he knows campaign finance reform." Never mind the realities, apparently. With six new state polls out since last week's 8/7 update , Barack Obama has expanded his Electoral College lead over John McCain . The Hotline estimates Obama now has 295 EVs to McCain's 231; one week ago, Obama led 292-234. Twelve EVs -- from IA and NM -- remain toss-ups. This week's 3 EV swing stems from a striking Hays Research Group poll which showed Obama ahead 45-40% in AK. This 5% lead just eclipses the poll's 4.9% margin of error and moves AK from lean McCain to solid Obama. It should be noted, however, that Hays surveyed adults while the previous three AK polls -- which all showed McCain ahead -- surveyed LVs. If Obama were to carry AK in Nov., he would be the first Dem to do so since Lyndon Johnson in '64. The five other polls released this week all corroborated previous findings. The latest AL Education Assoc. poll of AL LVs and Univ. of TX poll of TX RVs verified these states as solid McCain. Meanwhile new surveys by Franklin & Marshall College of PA RVs, Quinnipiac Univ. of NJ LVs and Strategic Vision (R) of WI LVs all solidified these Obama strongholds. As always, the chart includes all WH '08 state polling data published in The Hotline since 5/23. When asked who we are planning on supporting in the presidential election, our standard response is to avoid this query. It's a trick question premised on a mass delusion according to which people believe that one politician is better than another. We're pretty sure that the next president will be the worst in history, regardless of who wins. Perhaps less importantly, we know our votes count for almost nothing. Less than nothing, really. The costs incurred in voting--risking jury duty by registering to vote, having to trek to an out of the way public building we'd otherwise never know existed, standing in lines around people who we do not especially enjoy being around, witnessing the self-congratulatory grins of people who believe that they've performed some great democratic duty by voting for one scoundrel or another--are great. The rewards are few. They don't even serve lunch or whiskey at polling places anymore, we're told. ...

A member of the Green Party filed a lawsuit late last month challenging the constitutionality of the Electoral College . The lawsuit--filed July 28 in Washington DC--says that the popular vote in the 2008 presidential election may be misrepresented--as it was in 2000 and 2004--by the "winter take all" nature of the Electoral College. The civil action is designed to protect voting rights in the 2008 election by seeking the enforcement of the "Mal-Apportionment Penalty" in Section 2 of the 14th amendment to the United States Constitution. That amendment requires a reduction of a state's presidential electors and congressional representatives if "the right to vote at any election for the choice of electors for President and Vice President of the United States... is denied... or in any way abridged." The lawsuit names its target as Vice President Dick Cheney who will preside over the tabulation of Electoral votes on January 6, 2009. A press release announcing the lawsuit explains the undemocratic nature of the Electoral College: "If two thirds of the voters in a state vote for a candidate from Party A and one third vote for a candidate from Party B, and the state's winner-take-all rule gives all of the state's electors to Party A, then one third of the voters have been disenfranchised in violation of Amendment 14, Section 2 of the US Constitution," said Jody Grage, treasurer of the Green Party.
