The other day I posted a piece about the most recent set of negotiations (by the EU and others) with Iran . Lots of incentives were promised….if only Iran would stop its uranium enrichment program ( BN-Politics ). The Iranians have returned a reply. In the first official comments since Iran submitted its response to the EU, spokesman Gholamhossein Elham said that Iran “will not go back on its rights on the nuclear issue”. “Iran’s stand regarding its peaceful nuclear program has not changed. Iran insists on negotiations while respecting its rights and avoiding any loss of international rights,” BBC News ) I guess that means ‘no.’ The article suggests that there is, or at least may be, division of opinion among Iranian officials, but that President Ahmadinejad.has reaffirmed his commitment to the program. The rejection seems to have come from an official close to him. Along with the offer, Iran rejected a substantial package of sweeteners: The incentives package builds on a previous offer of 2006 and says that if Iran suspends uranium enrichment, then talks can start about a long-term agreement. On offer is recognition of Iran’s right to develop nuclear energy for peaceful purposes and the treatment of Iran in "the same manner" as other states under the Nuclear Non-Proliferation Treaty. In response to my blog entry (July 3), an obviously knowledgeable reader makes some interesting predictions about what may happen next, to wit: For the Swiss I believe the issue will be settled more by the intelligent application of technicalities and pragmatism than 'guts'. If, for example, the IRS serves the summons in Miami, the UBS staff will point out that they are a completely independent subsidiary and have nothing to do with records kept in Switzerland. If the IRS attempts to serve the summons in Swtzerland, the staff will point out they are governed by Swiss law, not U.S. law. No Proof for MLAT In Switzerland the authorities also will point out that not only does the summons have no standing there, the IRS attorney who drafted the summons recognized in writing that the IRS could not employ the Swiss-U.S. Mutual Legal Assistance Treaty (MALT) because they have no specific evidence regarding tax fraud. Moreover, the Swiss government understands that if they allow thousands of clients outside of the framework of international and Swiss law to be betrayed, then their banking industry will be irreparably harmed. Who will be knocking on their door next without proper evidence, the EU perhaps? In addition, very affluent, betrayed clients will not be happy folks. They will look to civil and criminal prosecution of UBS staff and management that enabled their prosecution by the IRS for tax fraud, a very serious crime in both Switze ... Maybe the EU doesnt need the Lisbon Treaty just now THE EU has certainly learned to live with institutional reform failure. The 3 pre-enlargement efforts either waffled on reform (the 1997 Amsterdam Treaty) or botched them (2001 Nice Treaty and the 2003 Constitutional Treaty). The 2 post-enlargement efforts were rejected by voters. (See my account of the 10 year "Trail to Failure", with some updates here.) Since my 1994 book on eastern enlargement, I've written many times that enlargement required reform of EU decision-making. Together with Mika Widgren, I've argued that EU decision-making would grind to a halt without it. I still believe institutional reform is necessary, but the data are not co-operating with the theory.
