A German court has ruled that the administrator of an EDonkey server can not be held liable for infringing downloads facilitated through the server if he takes reasonable steps to prevent such downloads. The court ruled against Warner Music Germany, which had sued the administrator last summer after they discovered songs of a Warner Music artist indexed by the server. Warner initially prevailed in court, but the admin appealed the ruling and was now able to defeat the major label, according to heise.de. Warner Music initially contacted the EDonkey server admin through their lawyer to stop the trading of an individual CD. The admin in question complied, putting keyword filters in place to make sure that the songs in question wouldn't get indexed again. Warner however discovered soon after that a different CD by the same artist was still available through the server and sued. The court now decided that the admin didn't participate directly in the infringement because his server did not actually host the audio files. It also ruled that there was no intentional facilitation of infringement because Warner's lawyers couldn't prove that the EDonkey network wasn't at its core a neutral network. The court finally decided that a keyword-based filtering system was enough to stop infringement and that the server admin wasn't required to proactively stop future infringements of titles that were not part of the original complaint. Wired reports that Comcast finally provided information on its network management practices late Friday. In a report to the FCC (PDF), the cable company admitted to targeting P2P protocols Ares, BitTorrent, EDonkey, FasTrack, and Gnutella. Quoting: "For each of the managed P2P protocols, the [Sandvine Policy Traffic Switch] monitors and identifies the number of simultaneous unidirectional uploads that are passed from the [Cable Modem Termination System] to the upstream router. Because of the prevalence of P2P traffic on the upstream portion of our network, the number of simultaneous unidirectional upload sessions of any particular P2P protocol at any given time serves as a useful proxy for determining the level of overall network congestion. For each of the protocols, a session threshold is in place that is intended to provide for equivalently fair access between the protocols, but still mitigate the likelihood of congestion that could cause service degradation for our customers." A court in Germany has ruled in favor of an administrator of an EDonkey server saying that he can not be held liable for infringing downloads through his server as long as he takes "reasonable steps" to prevent those downloads. In the decision, the court ruled against Warner Music Germany which had sued the admin last year after they found Warner Music songs indexed on the server. Earlier this year Warner actually won the case but the admin appealed and was successful this time. Warner Music contacted the admin after finding a single CD being shared and asked him to take it down. The admin complied accordingly and put "keyword filters in place to make sure that the songs in question wouldn't get indexed again." Warner however then found another CD by the same artist and began the lawsuit. The ruling, which should set a precedent at least in Germany, says the admin cannot be held liable because his server did not actually host the files in question. The court also added that "keyword-based filtering system was enough to stop infringement and that the server admin wasn't required to proactively stop future infringements of titles that were not part of the original complaint." Comcast came clean with the Federal Communications Commission late Friday, detailing how it throttled and targeted peer-to-peer traffic -- maneuvers it has repeatedly denied. The cable concern said (.pdf) it indeed hit "particular protocols that were generating disproportionate amounts of traffic." The peer-to-peer protocols, Comcast said, include Ares, BitTorrent, EDonkey, FastTrack and Gnutella -- vehicles used to transport copyrighted material without the owners' permission. On Aug. 1, when the FCC ordered it to abandon its throttling practices, Comcast denied that it was blocking any services including "peer-to-peer services" like BitTorrent or engaged in any blocking of services. Comcast spokeswoman Sena Fitzmaurice said at the time, "We are disappointed in the commission's divided conclusion because we believe that our network management choices were reasonable, wholly consistent with industry practices and that we did not block access to websites or online applications, including peer-to-peer services." By a 3-2 vote, the FCC concluded that Comcast monitored the content of its customers' internet connections and selectively blocked peer-to-peer connections in violation of network neutrality rules. The selective blocking of file sharing traffic interfered with users' rights to access the internet and to use applications of their choice, the commission said. A Spanish court has ruled that it is infact legal for a site to provide links to P2P downloads as long as they are not offering the files themselves and not working for "commercial gain." The Provincial Court of Madrid ruled in favor of Sharemula.com, a site whose sole purpose was to index EDonkey links to movies, games and music. EDonkey links are very similar to that of .torrent files, which do not contain any copyrighted material themselves but lead to such files. The site went under investigation in 2006 by the Federación Antipiratería and later 15 people were arrested in connection with the site. The case was even thrown out after being heard last year because the judge ruled the administrators of the site were not doing anything illegal and did not make a cent from the index. The media industry, including Columbia, Disney Company Iberia, Twentieth Century Fox, Warner, Universal, Paramount, Sony and MGM , appealed the decision however but have now lost again, and this decision can not be appealed. The hearing confirms the position of the defense that linking to P2P networks does not constitute a criminal offense, added David Bravo, a lawyer for the defense.
