UnknowingFool writes "Everyone's favorite CEO Darl McBride took the stand on Wednesday April 30 in Novell v. SCO. Chris Brown has posted his account on Groklaw of the 2nd day of trial. The first day's account can be found here. To refresh your memory in this ongoing case, Judge Kimball has already ruled that Novell owns the copyrights to Unix and has practically dismissed all of SCO's claims. This portion of the trial is about Novell's counterclaims that SCO never paid them the money from the Sun and MS deals. What is to be determined in this trial is how much of the money from the deals were for Unix licensing (SVRx) and how much were for SCO's server technology (Unixware)." (Read on for the rest, below.) Let's continue with our look at the trial testimony and finish up day 2 with our version of the transcripts with line numbers, the testimony of John Maciaszek. Our previous articles on day 2 covered the second day of Chris Sontag's testimony (which I put together with his first day, for logic and convenience), then Darl McBride's , and then Greg Jones' testimony . Those were Novell's witnesses, the ones it called. Novell's case having been fully presented, it was SCO's turn to put on its case, each side trying to present evidence to support their opening statements . The first SCO witness called is John Maciaszek. We've seen him before on paper, and so has Judge Dale Kimball. But this is our first opportunity to watch him in person. SCO already filed for bankruptcy and now Darl McBride Testified : Linux is a copy of UNIX, there is no difference First, Linux is kernel and not operating system. Linux distribution includes Linux kernel, GNU utilities, compilers and installation / management software. This guys is lying and nothing else. Amikor tavaly augusztusban Dale Kimball bíró úgy ítélkezett , hogy a Novell a UNIX és a UnixWare jogok tulajdonosa, úgy tűnt, hogy kifullad a szappanopera, a SCO előbb-utóbb belátja, hogy tévedett és nem erőlteti tovább ezt az ügyet. Information on some of the issues in the SCO related lawsuits were identified in our website a couple of months back. On April 30th trial became underway to determine the scope of what SCO owed Novell in unpaid royalties regarding its unauthorized licensing of Novell’s copyrights. ArsTechnica was there to catch CEO SCO describing an interesting variant of reality . Highlights include objectively verifiable claims that books on how to program Linux don’t exist , that there is no difference between Linux and Unix, and directly contracting his own SVP’s earlier testimony that they have evidence that System V Unix is in Linux.
