Beijing's silk market hosts innumerable crowded, noisy stalls selling decent replicas of Gucci sunglasses, Callaway golf clubs, and Polo T-shirts, all at a fraction of what the real thing costs. If you don't mind an upside-down logo or misspelled brand name, the value is terrific. However, if you turn up your nose at such inaccuracies, you are likely to be invited into a narrow five-floor tenement some 200 yards away, where the hallways smell of yesterday's fried rice, or worse, and where... ... Two digital rights advocacy groups have filed a lawsuit against the Office of the U.S. Trade Representative (USTR) in an attempt to get the office to turn over information about a secret international treaty being negotiated to step up cross-border enforcement of copyright and piracy laws. The Electronic Frontier Foundation (EFF) and Public Knowledge filed the lawsuit Wednesday after USTR ignored their repeated requests to turn over information about the proposed Anti-Counterfeiting Trade Agreement (ACTA). [ Your source for the latest in government IT news and issues: Subscribe to InfoWorld's Government IT newsletter . ] ACTA could include an agreement for the U.S., Canada, the European Commission and other nations that are part of the talks to enforce each other's intellectual-property (IP) laws, with residents of each country subject to criminal charges when violating the IP laws of another country, according to a supposed ACTA discussion paper posted on Wikileaks.org in May. The document posted on Wikileaks also talks about increasing border searches in an effort to find Counterfeit Goods, encouraging ISPs (Internet service providers) to remove online material that infringes copyrights and increased cooperation in destroying infringing Goods and the equipment used to make them. The full text of the ACTA has not been released, despite requests by EFF and Public Knowledge, as well as Canadian groups. Wikileaks is a site that pos ... Major League Baseball is not alone when it comes to fighting counterfeiters, who cost the sport millions of dollars a year in lost revenue. This morning, MLB unveiled a new hologram that is said to have "overt and covert elements that are designed to make it easier for both consumers and law enforcement to distinguish between licensed and bogus Goods." The new hologram, which will replace the current one that shows up on MLB Goods, will appear on 2008 post-season merchandise. The new design adds additional color and a sensory element, a raised stitch-like feature, that allows fans to see and touch the holograms to make sure they are real. As before, each hologram has an alpha-numeric combination unique to that item, the MLB silhouetted batter logo and other covert features. According to MLB, over the last five years, baseball has seized more than 4 million pieces of Counterfeit Goods. ... Source: www.sacbee.com --- 1 day ago

Congress is still trying to figure out how to handle the Internet. All too often, PK is in the position of defending online innovators from higher legal standards of secondary liability—holding a service provider or product manufacturer liable for the misdeeds of the users. Now, we’re starting to see more of this kind of secondary liability applied to online sales of physical Goods . Recently, bills in both the House and Senate are trying to deputize online retail markets (like eBay ) and turn them into police. Although the idea of shifting the burden of policing transactions onto these marketplaces in Counterfeit cases was recently rejected by a federal court, these bills are trying to revive it. The bills are trying to make it illegal to participate in a fencing scheme. For those of you uninitiated into the criminal underworld, a fence is a person who buys stolen Goods and resells them. For example, if I stole your TV and then gave it to my buddy who ran a local electronics shop to sell again, he would be my fence. Similarly, if my buddy didn’t own an electronics store and decided to sell it on eBay, he would also be a fence (although, unlike in the real world example, if my buddy sold the TV on eBay he would create a number of digital records that he could come to regret later). Wow, you might think, fencing should be illegal. Good news – fencing is illegal . These bills want to make it, well, more illegal. Also, they would ma ...
