Well, it looks like Psystar went from back alley boutique Mac cloner to being a defendant in a lawsuit in no time. Hopefully the cloner dudes spent their money on good lawers because, say what you will about Apple, one thing they do very well is sue people. "We take it very seriously when we believe people have stolen our intellectual property," said an Apple spokeswoman on Tuesday. This week, the Stanford Center for Internet and Society's Fair Use Project struck a telling blow in the battle to protect fair use. A US District Judge issued an opinion holding that the producers and distributors of the documentary Expelled: No Intelligence Allowed are likely to prevail on their fair use defense in a Copyright infringement Suit brought by Yoko Ono. As part of the film's commentary on the treatment of "intelligent design" in academia, the filmmakers included a snippet of John Lennon's "Imagine," highlighting the lyrics "Nothing to kill or die for / And no religion too." The filmmakers did not seek a license to use parts of "Imagine" in the film. This case builds on the Second Circuit's groundbreaking 2006 case, Bill Graham Archives v. Dorling Kindersley Ltd. , in which the Second Circuit noted that "courts are more willing to find a secondary use fair when it produces a value that benefits the broader public interest." In the current case, a bevy of interesting facts give rise to a good example of the balancing act that informs fair use -- the notorious four factors that are "weighed together, in light of the purposes of Copyright." In the opinion, the judge explores reasons that the 15-second sample might not be a fair use, such as the fact that film is a commercial work, and that the "Imagine" excerpt could be qualitatively significant as "the heart" of the copyrighted work. The University of Tennessee has settled with a sports fan group it had sued for what it said was Copyright infringement and counterfeiting in using the school’s athletic logos. Tennessee had sued the Big Orange Army and its parent organization in February, alleging that the group improperly used the school’s trademark “Power T” and other logos for sales and marketing. Tennessee athletic department spokeswoman Tiffany Carpenter said Monday that as a licensee the Big Orange Army organization now has permission to use the school’s trademark symbols. The settlement was finalized June 24. Jennah Jevning, a spokeswoman for Big Orange Army’s parent company, SportsMyx Holdings, said it would have no comment beyond a two-sentence statement Monday announcing the settlement. ... According to the Associated Press : Yoko Ono has lost her Manhattan legal battle to block the use of John Lennon's song "Imagine" in a film challenging the theory of evolution. EMI still has a state level Suit in New York against Premise Media for the inclusion of Imagine in Expelled , and no word yet when that might be resolved one way or the other. Associated Press is suing the Drudge Retort, naming a few bloggers and one commenter on a blog, in a lawsuit which alleges that excerpting phrases and linking to AP articles is not Fair Use. Good luck with that. In the meantime, let's all boycott AP - it's not as though they're the only newswire out there after all. I won't be linking to their stories or pictures from now on.
