A class-action lawsuit filed earlier this week targets Facebook and eight of the participants in Beacon, its ill-fated advertising product that shared information about third-party site activity with the social network. The set of twenty plaintiffs, mostly residents of Texas, filed the suit in the U.S. District Court for the Northern District of California on Tuesday. Named as defendants are Facebook, as well as current or former Beacon participants Blockbuster, Fandango (owned by Comcast), Overstock.com, STA Travel, Zappos, Hotwire (owned by IAC/InterActiveCorp), and GameFly. A Facebook representative told CNET News on Thursday that the company had not yet actually been served with the lawsuit, and that its legal team consequently did not have a formal statement at the time. STA Travel, Gamefly, and Overstock all declined comment; none of the other defendants could be immediately reached. "Until we're served, we're not being sued, so we don't have any comment," Overstock general counsel Mark Griffin told CNET News. Beacon gained almost immediate notoriety when Facebook unveiled it as part of its Facebook Ads announcement last fall. Privacy advocates, most notably liberal activist group MoveOn.org , lambasted the program for not allowing users to disable it easily. Earlier today, we published the article Comcast's Video Download Store Is Wholly Unremarkable about Comcast's expansion of Fancast, a place to download movies a la Amazon Unbox. Then a reliable tipster filled us in on where Fancast is going—specifically, in the mobile market. And we have to say, it's caught our attention. Fancast is essentially Comcast's way to expand into other areas of the entertainment sector without building on their cable monopoly. So their coming mobile app (working on Sprint phones for certain) includes partnerships with various media companies that may surprise you as part of a large media portal conglomerate. Sure, Fancast supports basic Comcast services. You can watch an unspecified amount of live programming on your phone streamed at what we've been told is near perfect quality (on a small screen). You can schedule recordings to your DVR and, maybe in later releases of the software, even stream these recordings to your phone a la Sling Box. You can rate movies and buy tickets on Fandango. And if other deals work out, you'll also be able to schedule recordings to your TiVo and add movies to your Netflix queue. Apparently the software is more than ready to go. Comcast is just finishing negotiations with various partners. So whenever those negotiations finish, that's when you'll get Fancast mobile. ...

Comcast ( NSDQ: CMCSA ) is getting ready to launch Fancast Mobile, a mobile application which will allow users to watch live programming on your phone, and schedule recordings on your DVR, reports Gizmodo ..Comcast has been talking about this possibility for a while now. There's not too many details on the mobile version right now, but one thing that is for certain is that it will work on Sprint phones. We're guessing this may have to do with Comcast's impending relationship with Sprint ( NYSE: S ) and Clearwire as a future investor in the combined WiMax venture. It's not surprising that it's not available on the iPhone since Apple ( NSDQ: AAPL ) has been particular about services that may compete with its plans for iTunes. Gizmodo also said Fancast Mobile will support basic Comcast services on your phone, such as watching an unspecified amount of live programming and scheduling recordings and maybe—in later releases—Slingbox-like streaming. You can also rate movies and buy tickets on Fandango, and possibly use your TiVo remotely and update your Netflix queue. Some acquisitions barely need explanations, That's not always the case when Comcast ( NSDQ: CMCSA ) Interactive Media opens the virtual checkbook; people are still asking me about Plaxo and today's announcement about DailyCandy, while less eyebrow-raising, still needs some 'splaining. CIM EVP Sam Schwartz and DailyCandy CEO Pete Sheinbaum did just that during an interview soon after the news broke. Neither would talk numbers but sources close to the deal say it's about $125 million. (They also declined to talk about information I had that the deal is roughly 10 times cash flow cash flow of about $13 million and total revenue of $23-25 million.) Schwartz described DailyCandy as "a high-monetization property" and "another step as we try to grow into a major presence" online. Comcast plans to keep the full DC team. Karin Gilford, the former GM of Entertainment at Yahoo ( NSDQ: YHOO ) who left earlier this week, is joining Comcast ( NSDQ: CMCSA ) as we reported earlier . Now her position there is official: she is joining as as SVP of Fancast and Online Entertainment. Gilford will build and manage Fancast , the online video service from Comcast Interactive Media, as well as work on expansion of CIM in the online entertainment space. She will report to Amy Banse, President of CIM. At Yahoo, Gilford was in charge of all programming, content and overall business strategies for Yahoo Entertainment's consumer websites, including Yahoo Movies, Yahoo TV and Yahoo omg!, and was based in its Santa Monica offices. Comcast and NetZero announces their plans to block child porn US based internet service providers Comcast and NetZero have announced their plans to join the list of ISPs which are going to block access to child porn. This was confirmed by the New York Attorney General’s office. This happened after Comcast was threatened by New York Attorney General Andrew Cuomo that he would sue the company if they do not accept their demands to block online access to child porn. Cuomo stated about the new developments: “I commend the companies for working with my office to aggressively eradicate online child pornography and strongly urge all outstanding Internet service providers across New York and the nation to get on board.” AOL, AT&T and Time Warner Cable have already accepted the demands and are now blocking online groups which offer child pornography content. Comcast posts higher profits Comcast is the largest cable service provider in the US market. The company has now come out with their latest revenue report and they have posted a higher quarterly profit. Comcast said that they gained market share in telephone and Internet services and were also able to control their expenses. They gained subscribers from rival services including AT&T Inc and Verizon Communications Inc. Market analyst Tom Eagan said in a statement on the company’s report: “Free cash flow was better than we expected and that was partly due to the fewer customer adds, so they didn’t incur costs of adding new subscribers.” Comcast reported that their net profit in the second quarter rose to $632 million. The revenues were up at $8.553 billion. Diehards have already bought up every seat for the midnight screenings on opening night a week from Friday at IMAX theatres in Natick and Reading. In fact, those tickets sold out within a few days of going on sale more than a week ago. "We know (the film) is going to be huge," said Vikky Angelico, a supervisor at the Comcast IMAX 3D Theatre in Natick. Dedham Community Theatre in historic Dedham Square will host a midnight premiere of the blockbuster sequel on July 18. Tickets are still available according to the theatre's Web site. While a host of companies like Apple, Microsoft, Netflix, Roku, and Sony roll out Internet TV devices, Comcast -- the current king of the living room -- isn't seeing much competition. If anything, Comcast CFO Michael Angelakis says, it's good for them -- more subscribers using high-speed cable Internet. "I think that we'll compete with them to get more content on video-on-demand and those kinds of aspects," Angelakis said today at Goldman's annual communication conference. "But we're not really seeing much impact from them as competitors. Actually, any impact." Angelakis says the company serves up some 300 million video on demand streams a month to its 16 million digital cable subscribers and hopes to end the year with 1,000 hi-def on-demand titles. Meanwhile, Angelakis thinks his company's two major Internet acquisitions this year -- email newsletter Dailycandy and contact manager Plaxo -- are "interesting"... We think DailyCandy is annoying. Always have. It's up there with Sugar Inc. But DailyCandy takes the cake because it is owned by Bob Pittman. If you saw the movie or read the book about Pittman's wife (Into Thin Air) you know why he seems like a jerk. But we have to concede that Pittman knows how to play the game. He has sold the DailyCandy business to Comcast for $125M. NYC-based DailyCandy was founded by Dany Levy in 2000. It is an online newsletter that targets women via e-mail newsletters on fashion, fitness, culture and lifestyle. The newsletters are free and ad -supported. Pittman reportedly paid just $3M for DailyCandy five years ago. So this is a cationary tale for your publishers who find success who want to cash out early. In a letter to DailyCandy's 55 employees, Pittman wrote that "since we made our investment in 2003, subscriptions have grown from just over 200K to over 2.5M." He also said he expects the company to rack up $25M in revenue this year on its way to $10M in earnings before interest, taxes, depreciation and amortization.
