Security Council Resolution 1769 -- which authorized deployment of the Darfur peacekeeping mission and 18 helicopters -- the Save Darfur Coalition delivered a shiny black helicopter , to the United Nations to jump-start stalled international relief efforts. "The U.N. has had a year to come up with helicopters," said Jerry Fowler, President, Save Darfur Coalition -- an alliance of more than 180 faith-based, advocacy and human rights organizations. "The Security Council must act to fulfill the promises they made to the Civilians of Darfur," said Fowler. The gesture underscored the need for leading nations to supply helicopters and basic supplies, from boots to ration packs, critically needed by the African Union-United Nations mission in Darfur (UNAMID) peacekeepers on the ground in Darfur. Among the many oddities of the U.S.'s first war crimes trial since World War II is this: The war crime for which Salim Hamdan was convicted, material support of terrorism, has never before been considered a war crime. As the nonpartisan Congressional Research Service put it in a report (PDF) last year, "Defining as a war crime the 'material support for terrorism' does not appear to be supported by historical precedent." Hamdan was not convicted of being involved in any plots against Civilians. Rather, he was found to have supported al-Qaida "through his service as a driver." Except as provided in Section 210.3(1)(b), criminal homicide constitutes murder when: (a) it is committed purposely or knowingly; or (b) it is committed recklessly under circumstances manifesting extreme indifference to the value of human life. Such recklessness and indifference are presumed if the actor is engaged or is an accomplice in the commission of, or an attempt to commit, or flight after committing or attempting to commit robbery, rape or deviate sexual intercourse by force or threat of force, arson, burglary, kidnapping or felonious escape. Since killing Civilians is inevitable in modern warfare it cannot be called an accident. Bombers and helicopter pilots don't necessarily intend to kill Civilians, but when they attack villages and crowded city streets they know that Civilians will be killed. When soldiers and Marines on the ground cannot tell the difference between a civilian and an insurgent and are told to clear an area, they will kill Civilians. This killing may not be deliberate, but it is not an accident. The civil and criminal legal analysis almost begs to be applied here.   ...
