Robert LaPointe could face a bill of as much as $800,000 to compensate the families of two Maine residents killed last August in a boating accident as part of a Civil case filed after the accident. LaPointe, a Medway resident, was found guilty Wednesday of two counts of aggravated drunken driving in connection with the deaths of Terry Raye Trott and Suzanne Groetzinger. On the more serious charges of manslaughter and reckless conduct with a dangerous weapon, the Maine jury was deadlocked, forcing a mistrial. Prosecutors in Maine have said they will decide whether to refile the manslaughter charges after LaPointe is sentenced. He is expected to be sentenced in November to between one and three years in prison. The guilty verdict, however, clears the way for a lawsuit filed against LaPointe by the Trott and Groetzinger families. "The claim in the Civil case is that Mr. LaPointe was negligent, and that his negligence caused the deaths of two people," said Benjamin Gideon, an attorney for the Groetzinger family. "The criminal verdict will resolve, as a matter of law, the issue of liability in the Civil case. "He will not be able to argue in the Civil case he was not negligent. That was foreclosed by the finding beyond a reasonable doubt that he was guilty of aggravated operating under the influence. As a matter of law, that would be negligent," Gideon said. District Judge Bill Maddox ruled that the law to remove public officials applies only to local government officers and not to state officials. Judy Sheldrew, the attorney for Loux, said called the Suit brought by conservative spokesman Chuck Muth “frivolous.” Sheldrew said she would now turn her attention to a complaint filed with the state Ethics Commission by Assembly Minority Leader Heidi Gansert, R-Reno. Sheldrew said she would seek attorney fees to be paid by Muth. The hearing lasted less than 30 minutes in Carson City District Court and Muth later said he would not appeal the decision. But Muth said he would “put pressure” on the attorney general’s office to investigate whether a crime had been committed.
