A federal judge has ruled against a challenge to the security plans put in place for the Democratic National Convention. The ruling came in response to a lawsuit filed by the American Civil Liberties Union of Colorado on behalf of advocacy Groups that contend the plans are an unconstitutional restriction on free-speech rights. The designated public protest zone is more than 700 feet away from the entrance to the Pepsi Center, where the convention is being held, and will be obstructed from delegates' view by a media tent. Still to be considered are the security plans for Barack Obama's acceptance speech, which will be held at the Denver Broncos' stadium, Invesco Field at Mile High. A hearing on those plans has been scheduled for Aug. 12. ...

Two senators are seeking to delay new Justice Department rules that would let the FBI investigate Americans without any evidence of wrongdoing. The lawmakers fear the rules could lead to the singling out Muslims, Arabs or other racial and ethnic Groups. In a letter Monday, Democratic Sen. Patrick Leahy of Vermont and Republican Sen. Arlen Specter of Pennsylvania said the proposed rules raise potential Civil Liberties concerns. They asked Attorney General Michael Mukasey to hold off finalizing the rules until Congress can hold hearings. A Justice Department spokesman said the letter was being reviewed. The rules are known as the attorney general guidelines, and they govern how the FBI runs national security investigations. They are expected to be finalized later this week or early next week. ...

2008-08-05 PENTAGON CLOSES CONTROVERSIAL INTELLIGENCE UNIT WASHINGTON ( Reuters ) - The Pentagon on Monday said it was closing a controversial intelligence office that had raised concerns about domestic spying by the military after the September 11 attacks. The Defense Department said it had "disestablished" the Counterintelligence Field Activity office, or CIFA, created in February 2002 by former Defense Secretary Donald Rumsfeld to manage defense and armed service efforts against intelligence threats from foreign powers and Groups such as al Qaeda. Those responsibilities will now be carried out by a new organization called the Defense Counterintelligence and Human Intelligence Center, overseen by the Pentagon's Defense Intelligence Agency. CIFA's operations stirred concern among members of Congress and Civil Liberties advocates. A CIFA database known as Talon, set up to monitor threats against U.S. military installations, was found to have retained information on U.S. antiwar protesters including Quakers after they had been found to pose no security danger, officials said. Talon, the acronym for Threat and Local Observation Notice, was ended last year as a result of the outcry. But the controversy, leading the Defense Department to reorganize CIFA's functions after a broad review of Pentagon intelligence operations, officials said. Maryland Governor Martin O`Malley has appointed a former federal prosecutor to conduct a review of spying conducted by the State Police. Stephen Sachs, who served as a U.S. attorney and Maryland's attorney general, will head the review of surveillance that agents from the State Police conducted on anti-death penalty Groups and peace activists. The spying happened during 14 months in 2005 and 2006 -- before O'Malley became governor. It was described in documents the American Civil Liberties Union sued to obtain from the State Police. Sachs says he wants to ensure police do not infringe on citizens' rights to free speech. He adds his review will be independent and objective. Sachs was U.S. attorney for Maryland from 1967 to 1970.
