Just days after Tiffany appealed the correct US ruling that eBay isn't liable for counterfeit goods sold on the site, a Belgian Court has sided with eBay in a very similar lawsuit involving L'Oreal. Apparently, the Belgian courts understand how liability works a lot better than their neighbors in France, who ruled the other way in a case involving Louis Vuitton. L'Oreal says it's "surprised" by the decision and will appeal, but fails to explain why eBay, as a platform maker, should be responsible for what people do with that platform. About the only answer seems to be that L'Oreal recognizes eBay is an easier target than going after those actually responsible (those selling the counterfeit goods). EBay won another victory today in its far-flung legal battles with trademark owners. According to the wire service AFP, a Belgian Court ruled that the auction house was not required to police its site to prevent counterfeit goods from being sold. The ruling, which came on a lawsuit by cosmetics maker L'Oreal, mirrors a decision last month by a federal judge in New York to reject Tiffany and Co.'s claims against eBay. By contrast, a Paris Court held in June that eBay was liable for the sale of counterfeit Louis Vuitton goods and other luxury items. (EBay is appealing.) Tiffany, which filed an appeal this week of U.S. District Judge Richard Sullivan's ruling, argued that eBay was liable for the sale of counterfeit goods because it didn't take the initiative to block suspect sales — e.g., someone offering multiple "Tiffany" items at a deep discount. EBay countered that its only duty was to block the auctions that Tiffany fingered. Sullivan agreed, saying the enforcement burden was on trademark owners, not middlemen such as eBay. Rulings by Sullivan and the Belgian commercial Court offer an important bit of clarity about the duties of online intermediaries whose platforms and services become a vehicle for violating intellectual property rights. LONDON — A Belgian Court Tuesday found in favor of eBay in a case brought against the Internet auction site by L’Oréal-owned Lancôme over the sale of counterfeit products. The French beauty behemoth, which said it intends to appeal the decision, had aimed to stop eBay from allowing the sale of what it considers counterfeit goods on the Belgian version of its site. It had also requested that the site take several steps to counteract the sale of counterfeit Lancôme goods, including banning certain selling activity — such as the sale of more than three perfumes in a month by the same seller. “We are very pleased with the Belgian Court’s decision,” said an eBay spokeswoman, adding the site had taken down product listings that L’Oréal had contested. “We’re pleased that the Court acknowledged the fact that eBay is willing to work together with rights holders. EBay wants to work together with brands rather than engage in litigation.” According to the spokeswoman, the Court considers eBay an online host stocking information generated by users and is not responsible for the veracity of that information. “L’Oréal believes the Court to be mistaken in its decision to minimize the role of eBay in the sale of products on its platform,” the French firm stated. “L’Oréal believes that this judgment by the Court digresses from the interpretation of the e-commerce directive provided in recent months by the European Commission.
