As I've reported recently, the changes to family law in Australia that created a presumption of equally shared parenting were passed in 2006. With far too little time having passed to tell if they worked well or ill, anti-father forces there immediately started agitating for repeal. The Rudd government commissioned studies which have now been published. The good news is that a solid majority of parents whose cases were actually controlled by the new law reported that they were well satisfied with the experience. That had a lot to do with the fact that the laws pushed divorcing parents toward alternative dispute resolution methods and away from courts and lawyers. I've said for some time that the less attorneys are involved in the already contentious area of divorce, the better. Simply put, attorneys tend to heighten conflict, and pretty much all agree that that's a bad thing for everyone in divorce matters. For one thing, the greater the conflict, the more kids tend to suffer. So on those two measures, the new laws must be considered a success. Well, not by everyone. Family attorneys in Australia don't like the new laws a bit. Why are we not surprised? The more divorces are decided without resort to attorneys, the less money there is for attorneys.
