Another state is accusing Countrywide Financial of mortgage fraud. Connecticut joined California, Florida and Illinois among the states that have sued Countrywide, which was responsible for one in every six mortgages in 2007, according to the New York Times . The State of Connecticut is accusing the mortgage giant of steering customers into mortgages they could not afford, and charging excessive legal fees to borrowers in default. Most of these practices were executed through the use of vague language and misinformation on the loans' Truth in Lending disclosure forms ( TILA violations , such as not stating that many of the subprime loans Countrywide wrote were negative amortization loans; a violation of the Truth in Lending Act). Richard Blumenthal, Connecticut's Attorney general, said today that, "Countrywide conned customers into loans that were clearly unaffordable and unsustainable, turning the American dream of homeownership into a nightmare." Connecticut, in the lawsuit that was filed with Hartford Superior Court, is demanding that Countrywide make restitution to affected borrowers, give up improper gains, and rescind, reform or modify all mortgages that broke state laws. Connecticut's complaint described the lending practices of Countrywide as, "oppressive, unethical, immoral and unscrupulous," (New York Times, 8/7/08). County Attorney David Yoder won a second full term as county Attorney during the Republican primary Tuesday. Yoder beat challenger Mike Hoelscher, receiving 2,123 votes to Hoelscher’s 1,562 votes to clinch the nomination and the race. Yoder faces no opposition in the November general election. Although there were Democratic write-in votes registered in the election count, there is no viable Democratic candidate, County Clerk Joyce Truskett said. Some people had marked the write-in bubble and written no name, and others had written in one of the candidates on the Republican ticket, which the law does not allow, Truskett said. Yoder said he was disappointed his challenger took a negative tack in his campaign. “I made a conscious effort to maintain a high level of integrity,” Yoder said. “I ran a clean campaign throughout. I was appalled at my opposition’s lack of integrity and negative, vicious attack on the last night before the election.” Yoder said he thought his experience and community involvement helped sway voters. “I believe the community saw through the negativity and chose the better candidate,” he said. The Attorney for former Griswold employee Andrea Charron grilled former First Selectman Anne Hatfield on the witness stand for close to an hour Thursday morning. Jacques Parenteau, Charron’s Attorney, asked Hatfield what she knew about the insurance policy on the old town hall that burned Jan. 3, 2006. “You knew that no one had called to cancel the insurance, correct?” Parenteau asked. “That’s what I’d been told,” Hatfield replied. “Well if you’ve been told it, that’s what you knew,” Parenteau said. Parenteau also asked if Charron, as resident of Griswold, had the right to speak up against the unethical practices of an employer. Hatfield said Charron’s complaint wasn’t legitimate.
