ASPEN - I took part in an interesting panel last night at the Aspen Ideas Festival, discussing the ins and outs of Barack Obama and John McCain with David Brooks, Stuart Rothenberg, Jim Wallis, Jonathan Capehart, Amy Goodman, and Jonathan Alter moderating. I was particularly interested in the takes of Brooks and Rothenberg. They were smart, knowledgeable, eloquent... and utterly wrong. Brooks was even-handed with both candidates. He suggested that McCain's biggest failing was his weakness as a manager (I said I was far more concerned with the disastrous direction in which he wants to lead the country). And he criticized Obama for lacking the "Senatorial skills" of either McCain or Hillary Clinton. (In an unrelated riff, Brooks let the audience know that, based on an off-the-record conversation with President Bush, he could categorically assure us that we would not be bombing Iran.) Towards the end of the panel we were all asked whom the nominees should pick as their VP. One of Brooks' recommendations for Obama was Tom Daschle because the former-Senator understands how to get things done. In Brooks World, the presidency is all about keeping the machinery greased and the cogs of government running smoothly. It's leadership as McDonald's management: keep serving up the tried and true, with maximum efficiency. John McCain, aided and abetted by his loving protectors in the media, is running a victory lap on Iraq. To hear them tell it, the surge has "worked" -- indeed, it has been a huge success -- and this, like a last second Hail Mary pass, has vindicated the entire disastrous Iraq misadventure. Buoyed by a reduction in violence in Iraq, war supporters are crawling out from the shadows and beating their chests. "I am proud of the decision of this administration to overthrow Saddam Hussein," Condi Rice told Judy Woodruff last week. This echoed the comments of her boss, who crowed at a GOP awards dinner at the end of June : "The decision to remove Saddam Hussein was the right decision at the time, and it is the right decision today." Bush even felt emboldened to dust off blast from the past and claim: "Democracy is taking root where a tyrant once ruled." And the media -- and even a number of Democrats -- are swallowing this triumphalist nonsense whole, and washing it down with a pitcher of revisionist Kool-Aid. The result: a collective case of political amnesia. Everyone seems more than happy to forget what the president's own stated goal for the surge was: to create "the breathing space [the Iraqi government] needs to make progress in other critical areas." Karl Rove ain't coming. And he ain't talking. Except on Fox News. Despite being subpoenaed by the House Judiciary Committee to testify on his role in politicizing the Justice Department -- and in using the Department to selectively prosecute Democratic officials -- the erstwhile Boy Genius has announced that he won't be showing up at tomorrow's scheduled hearing. He claims that the president's assertion of executive privilege "obligates" him to disregard the Congressional order. By doing so, Rove is thumbing his nose at Congress, legal precedent, the public's right to know the truth -- about, among other things, the firing of nine U.S. attorneys and the blackballing of Justice Department hires -- and the Constitution. In 1776, Thomas Paine -- America's first blogger -- wrote in Common Sense: "in America the law is King. For as in absolute governments the King is law, so in free countries the law ought to be King; and there ought to be no other." But throughout its seven-plus years, the Bush administration has demonstrated an unwavering belief that it is above the law and a deep-rooted disdain for checks and balances, and the Constitutional imperative of coequal branches of government. Rove's refusal is, of course, part and parcel of the Bush White House's ongoing efforts to keep its actions cloaked in secrecy. But beyond that, it is further evidence that for Bush/Cheney and company the ultimate power in America lies in their hands ...
