Apple Employees have filed a class action suit against the Cupertino-based company for its alleged non-payment of overtime and meal compensations. If found guilty, Apple could be ordered to revise its compensation policies and pay retroactive wages. Lead plaintiff David Walsh says Apple had him working over 40 hours a week without getting overtime pay. He also says he's been placed on call during weekends and denied meal allowances. Walsh says his position in Apple as a network engineer was deliberately classified by the company as a management post to serve as an excuse to not pay him overtime. He's not alone as other Employees holding similar jobs raised their cases. The case is now set to be heard. We'll give you an update on how this fiasco turns out. Embellishment of the Year Award goes to David Walsh and his crack team of hyperbolical lawyers, who filed suit against Apple on Monday alleging the company subjects its California IT workers "to conditions resembling indentured servitude and, in violation of California state law, are denied required overtime pay and meal benefits." Indentured servitude ?! Like "a vicious circle, in which an indentured servant would become further indebted to their employer, who would forgive the debt in exchange for an extension to the period of their indenture, which could then thereby continue indefinitely"? Walsh was a victim of "violence, abuse, mistreatment and subjugation at the hands of their employers in the homes and fields in which they worked"?? David Walsh, who worked as a network engineer at Apple from 1995 until last year, was routinely forced to work more than 40 hours per week, missed meals, and often had to spend evenings and entire weekends on call without receiving an extra dollar of pay, according to the suit. Oh. Well, close enough I guess. It's no surprise that Apple demands a lot from its Employees, particularly with regards to hours they put in and dedication to their jobs. So the tech and geek crowd is a little underwhelmed by the new $300 million Microsoft advertising campaign featuring Jerry Seinfeld that kicked off tonight . It's mostly content free, with just one mention of Microsoft near the end. It's a far cry from the brilliant Microsoft v. mac ads that Apple has run over the years. So what's the deal? In an email we've obtained from Microsoft SVP Bill Veghte to all Employees, he talks about the goals of the campaign. The overall goal is to inspire consumers and "tell the story of how Windows enables a billion people around the globe to do more with their lives today." This first phase, he says, "is designed to engage consumers and spark a new conversation about Windows – a conversation that will evolve as the campaign progresses, but will always be marked by humor and humanity."
